According to media reports, three former and current students of the University of Dhaka- Sheikh Tasnim Afroze Emi, Md. Asif Ahmed Soikat and Abdul Al Mamun were detained and sent to jail under the Anti-Terrorism Act for broadcasting the speech of Bangabandhu Sheikh Mujibur Rahman through a microphone.

On the same day, four other citizens who went to place ফুল at Bangabandhu’s residence at Dhanmondi 32 to pay their respects were also detained and arrested under the same law. HRFB views these actions by the police as a violation of the constitutional right to freedom of expression. HRFB calls upon the government to investigate these incidents, including acts of taking the law into one’s own hands and violations of citizens’ rights, and to take appropriate action against those responsible. At the same time, HRFB condemns the abuse of power by the police and the apparent influence of partisan political considerations.

HRFB believes that Bangabandhu’s historic 7 March speech is a defining moment in Bangladesh’s struggle for independence and an integral part of the nation’s history. Therefore, broadcasting the speech or paying tribute to it cannot, under any circumstances, be considered a criminal offence. Rather, it is part of the country’s historical and cultural heritage and a recognised right of citizens in a democratic state.

To our knowledge, there has been no precedent of prohibiting the commemoration of any speech or historical event recognised as part of the nation’s history and Liberation War. In a democratic society, the right to remember history, express opinions and pay tribute peacefully forms part of the fundamental freedoms of citizens.

HRFB believes that it is the responsibility of the State to protect citizens’ freedom of expression, cultural rights, freedom of movement and personal dignity. Under no circumstances should fundamental rights be curtailed through the application of law, social pressure or informal power structures. Articles 27, 33 and 37 of the Constitution of Bangladesh guarantee equality before the law, personal liberty, rights after arrest, fair trial, peaceful assembly and freedom of expression.

In this context, HRFB calls upon the concerned authorities of the government to:

Conduct an independent and impartial investigation into the arrests related to the broadcasting of the historic 7 March speech and the observance of the day;
Immediately release the citizens arrested under the Anti-Terrorism Act.

HRFB emphasises that prompt and responsible action is necessary to uphold the fundamental rights recognised in the Constitution of Bangladesh and the country’s international human rights commitments, and to build a tolerant, democratic and rights-respecting society.

৭ মার্চের ভাষণ প্রচার বা দিন উদযাপনকে কেন্দ্র করে সন্ত্রাস বিরোধী আইনে গ্রেফতারের ঘটনায় হিউম্যান রাইটস ফোরাম বাংলাদেশ (এইচআরএফবি) এর উদ্বেগ ও নিন্দা

[ঢাকা, ১১ মার্চ ২০২৬] সংবাদমাধ্যমে প্রকাশিত সংবাদ সুত্রে জানা যাচ্ছে, ৭ মার্চ ১৯৭১ এ দেয়া বঙ্গবন্ধু শেখ মুজিবুর রহমানের ভাষণ মাইকযোগে প্রচার করার জন্য ঢাকা বিশ্ববিদ্যালয়ের সাবেক ও বর্তমান তিন শিক্ষার্থী, শেখ তাসনিম আফরোজ ইমি, মো আসিফ আহমেদ সৈকত, আব্দুল আল মামুনকে আটক করে সন্ত্রাস দমন আইনে মামলা দিয়ে কারাগারে পাঠানো হয়েছে।

একই দিনে ধানমন্ডির ৩২ নম্বরে বঙ্গবন্ধুর বাসভবনে ফুল দিয়ে শ্রদ্ধা জানাতে যাওয়া চার জন নাগরিককেও আটক করে একই আইনে গ্রেপ্তার করেছে। এইচআরএফবি পুলিশের এই পদক্ষেপগুলিকে মত প্রকাশের স্বাধীনতার সাংবিধানিক অধিকারের লঙ্ঘন হিসেবে দেখে। এইচআরএফবি সরকারকে এই ঘটনাগুলির তদন্ত করার আহ্বান জানাচ্ছে, যার মধ্যে নাগরিকদের উপর হামলা করার জন্য আইন নিজের হাতে তুলে নেওয়া এবং অধিকার লঙ্ঘনের জন্য দায়ীদের বিরুদ্ধে ব্যবস্থা নেওয়ার আহ্বান জানাচ্ছে। অন‍্যদিকে পুলিশের ভূমিকায় ক্ষমতার অপব্যবহার ও দৃশ্যমান দলীয় রাজনৈতিক প্রভাবের নিন্দা জানাচ্ছে এইচআরএফবি।

হিউম্যান রাইটস ফোরাম বাংলাদেশ (এইচআরএফবি)মনে করে, বঙ্গবন্ধুর ঐতিহাসিক ৭ মার্চের ভাষণ বাংলাদেশের স্বাধীনতা সংগ্রামের অন্যতম গুরুত্বপূর্ণ দিকনির্দেশনা এবং জাতীয় ইতিহাসের অবিচ্ছেদ্য অংশ। ফলে এ ভাষণ প্রচার করা বা এর প্রতি শ্রদ্ধা নিবেদন করা কোনোভাবেই অপরাধ হিসেবে বিবেচিত হতে পারে না। বরং এটি দেশের ইতিহাস, সাংস্কৃতিক ঐতিহ্য ও গণতান্ত্রিক রাষ্ট্রে নাগরিকের স্বীকৃত অধিকার।

দেশের ইতিহাস ও মুক্তিযুদ্ধের স্মারক হিসেবে স্বীকৃত কোনো ভাষণ বা ঐতিহাসিক ঘটনার স্মরণকে নিষিদ্ধ করার কোন ঘটনা ঘটেছে বলে আমাদের জানা নেই। একটি গণতান্ত্রিক রাষ্ট্রে ইতিহাস স্মরণ, মতপ্রকাশ এবং শান্তিপূর্ণভাবে শ্রদ্ধা নিবেদনের অধিকার প্রত্যেক নাগরিকের মৌলিক স্বাধীনতার অংশ।

হিউম্যান রাইটস ফোরাম বাংলাদেশ মনে করে, রাষ্ট্রের দায়িত্ব হলো নাগরিকের মতপ্রকাশের স্বাধীনতা, সাংস্কৃতিক অধিকার, চলাফেরার স্বাধীনতা এবং ব্যক্তিগত মর্যাদা রক্ষা করা। কোনোভাবেই যেন আইন প্রয়োগ, সামাজিক চাপ বা অনানুষ্ঠানিক ক্ষমতার বলয়ে মৌলিক অধিকার সংকুচিত না হয়। বাংলাদেশের সংবিধানের ২৭, ৩৩, ৩৭ অনুচ্ছেদ নাগরিকের আইনানুগ সুরক্ষা, ব্যক্তিস্বাধীনতা, গ্রেপ্তার-পরবর্তী অধিকার, ন্যায্য বিচার, শান্তিপূর্ণ সমাবেশ, মতপ্রকাশের স্বাধীনতা নিশ্চিত করেছে।

এই প্রেক্ষাপটে এইচআরএফবি সরকারের সংশ্লিষ্ট কর্তৃপক্ষের প্রতি আহ্বান জানাচ্ছে-

১. ঐতিহাসিক ৭ মার্চের ভাষণ প্রচার ও শ্রদ্ধা নিবেদনকে কেন্দ্র করে গ্রেপ্তারের ঘটনাগুলোর নিরপেক্ষ ও স্বাধীন তদন্ত করা হোক;

২. সন্ত্রাস দমন আইনে গ্রেফতারকৃত নাগরিকদের অবিলম্বে মুক্তি দেয়া হোক;

বাংলাদেশের সংবিধানে স্বীকৃত মৌলিক অধিকার ও আন্তর্জাতিক মানবাধিকার প্রতিশ্রুতির আলোকে একটি সহনশীল, গণতান্ত্রিক ও মানবাধিকারের প্রতি শ্রদ্ধাশীল সমাজ গড়ে তোলার জন্য উপরোক্ত বিষয়গুলোতে দ্রুত ও দায়িত্বশীল পদক্ষেপ নেওয়া জরুরি বলে এইচআরএফবি মনে করছে।

Around 25 participants from different human rights organizations participated in this consultation and actively engaged in group work and discussions. Faruq Faisel, the Executive Director of ASK and convener of the forum, welcomed the participants to the event. Zakir Hossain, the Chief Executive of Nagorik Uddyog, shared his insights about attending the UPR sessions over the years. He highlighted how the UPR proceeding started and the scope of the CSOs to lobby with the government on several human rights issues.

Tamanna Hoq Riti, Coordinator, ASK, gave a brief presentation on the 4th UPR outcome document and divided the participants into four groups, focusing on civil and political rights, women’s rights, workers’ rights and marginalized people’s rights. Then, the participants analyzed the thematic recommendations and brought up their comments about what can be done to implement those recommendations. Afterwards, she shared the government responses with the participants. Lastly, the participants adopted a plan of action for HRFB with the aim of continuing the forum’s effort to promote human rights in the country.

Ain o Salish Kendra (ASK), as the Secretariat of Human Rights Forum Bangladesh (HRFB), arranged a ‘Consultation on the implementation of UNCAT Recommendations: Assessing Progress and Challenges of Bangladesh’ on 3 November 2021, with its member organizations at the Conference Room of ASK. The meeting was presided over by Golam Monowar Kamal, Executive Director, ASK, and Convener, HRFB.
The draft progress report on the implementation was shared by Cynthia Farid, Advocate, Supreme Court of Bangladesh.
Zakir Hossain, Chief Executive, Nagorik Udyog, and Ranjan Karmakar, Executive Director, Steps Towards Development, both members of the Steering Committee were present in the discussion to share their valuable opinion.
The representatives of the HRFB member organisations participated in the event to share their views on the report as well.

Human Rights Forum Bangladesh (HRFB) is deeply concerned at the rising incidence of various forms of violence against women, including rape, in the country. The Forum welcomes the government’s recognition of the urgency of reforming the law, but it fears that the inclusion of death penalty as one of the punishments will not bring the desired benefits.

Besides, it wants to draw attention to the fact that the inclusion of capital punishment—which is incompatible with contemporary human rights standards—will not be enough to prevent these heinous crimes. To achieve meaningful change, we need changes to more than just the nature or degree of punishment. We need reforms to overcome the existing limitations of the relevant laws, to address the challenges faced in obtaining medical reports and other forms of evidence, along with other challenges faced by survivors in accessing justice; our education system and curriculum needs reforms as well.

Overall changes in how women are perceived in society are crucial, and for that some coordinated initiatives must be taken. More than capital punishment, we need to ensure appropriate punishment to prevent crimes and after conducting psycho-social analyses, undertake reform-oriented steps against the perpetrators.

It is not the severity of the sentence, but confidence and trust in the justice system which can effectively contribute to the prevention and eradication of such crimes. To that end, we must focus on the proper implementation of the law, and transparency and accountability in the process through regular monitoring. In view of the additional barriers faced by rape survivors in certain geographical regions such as the Chittagong Hill Tracts and those from certain marginalised communities, such as indigenous women, Dalit women/girls, persons with disabilities and the hijra community, we urge the government to take special care and context-based preventive and remedial measures.

HRFB believes that the failure to bring rapists to justice is one of the many factors behind the rise of rape incidents in the country. The existing social, educational and political contexts all play a significant role in the increasing propensity of crime and its sustenance. If we do not acknowledge the structural factors which create the mentality of rape in our society and prevent achieving justice, then rape will not be eradicated.

Legal reform is undoubtedly important and many human rights organisations have been demanding specific reforms to overcome the limitations of the relevant laws for a long time. The Rape Law Reform Coalition has issued a 10-point demand on legal and institutional reform, including the enactment of a Victim and Witness Protection Act, the establishment of a state compensation fund for rape survivors, expansion of the legal definition of rape to make it non-discriminatory, and gender-sensitisation training of justice actors.

Within the existing legal framework, many survivors of rape, families of those who were raped and killed or died as a result of rape, are not getting justice and are having to face different type of harassment while seeking protection or justice. On the other hand, while the judicial processes are supposed to be completed within 180 days, due to weaknesses in the investigation, prosecution and judicial processes, most of these cases either drag on for a long time or the perpetrators escape justice altogether.

Social scientists and legal professionals have already expressed apprehensions that the new provision of capital punishment for rape is likely to result in an increase of post-rape killings since perpetrators would want to silence survivors or witnesses from speaking out against them. The Forum would like to reiterate that the death sentence as a punishment is incompatible with all contemporary standards of human rights.

Without taking specific initiatives in ensuring strict application of the laws, along with the adoption of necessary legal reforms and the holding of discussions with relevant stakeholders, this sudden incorporation of the death penalty as a maximum punishment will not achieve any meaningful change. The Forum rather believes that this move will be perceived as a politicaltactic.
