<p>Necessary Compensation and Injury costs for Victims of Garment Factory disasters are a responsibility of the Government and the businesses involved.</p>
<p>The video begins with a clip from a Regional consultation which was held by the Asian Pacific Women in Law and Development, ASK and Nijera Kori on &#8221;Framing Development Justice&#8221; . The government representative from the Ministry of Foreign Affairs, Saida Muna Tasneem spoke about the positive aspects of the growing garment industrys and how &#8221;economic empowerment is the mother of all empowerment&#8221; for women.</p>
<p>In the context of the garment industry, this video was designed to show the basic rights which are not being met by garments workers and issues which they face.</p>
<p>This video was shown at the National Consultation on women in the garments sector, where activists from the ground were able to bring issues directly to UN Mandate holders Heisoo Shin, an Expert Member from the Committee which monitors the implementation of the International Covenant on Economic, Social and Cultural Rights by its Member States parties. Kamala Chandrakirana, Member of working group on the discrimination against women in law and in practice and Milena Pires, Expert Member, from the Committee for the Elimination of Discrimination Against Women, the committee recommendations on any issue affecting women to which it believes the States parties should devote more attention.</p>
<p>This video features Sara Hossain speaking at the &#8221;Framing Development Justice Regional Consultation which was held on the 27-28th October 2013.</p>

<p>The national consultation with the special United Nations Mandate Holders on “Framing Development Justice” for women in the Readymade Garments (RMG) sector of Bangladesh was held at the BRAC Centre Inn Auditorium <b>on October 30<sup>th</sup>, 2013</b>. The consultation was organised by the Asia Pacific Forum on Women, Law and Development (APWLD), Ain o Salish Kendra (ASK) and Nijera Kori. The consultation brought together various stakeholders of the sector, including workers, union leaders, activists and authorities, to hear the experiences of women suffering from occupational hazards in the RMG industry and identify the challenges that need attention and action. It enabled the voices from the ground to reach the UN special mandate holders. They advised to the activists to submit official communication to the relevant special procedures addressing the realities.</p>
<p>Khushi Kabir, Coordinator of Nijera Kori moderated the discussions.</p>
<h1 style="text-align: left;"><strong>Who Were the Mandate Holders?</strong></h1>

<p><em><strong>Heisoo Shin</strong></em> is an Expert Member of the Committee on the Economic, Social and Cultural Rights, which is constituted with  <a title="Membership" href="http://www.ohchr.org/EN/HRBodies/CESCR/Pages/Membership.aspx">18 independent experts</a> to monitor the implementation of the International Covenant of Economic, Social and Cultural Rights by States parties.</p>
<p><em><strong>Kamala Chandrakirana </strong></em>is a Member of working group on the D<a href="http://www.ohchr.org/en/issues/women/wgwomen/pages/wgwomenindex.aspx">iscrimination against women in law and in practice</a>.</p>
<p><em><strong>Milena Pires</strong></em> is an Expert Member of the Committee on the Elimination of Discrimination against Women (CEDAW). The Committee monitors the implementation of the convention on the Elimination of the All Forms of Violence Against Women.</p>

<p><strong>Living Wage for the Workers</strong></p>
<p><strong><em>Kate Lappin- Regional Coordinator of APWLD </em></strong>in her presentation explained that, the living wage,calculated based on a combination of food and non-food costs, is the minimum income required to meet the basic costs of living for a family of two adults and two children, without requiring overtime work. She showed that the calculated living wage for Bangladesh is Tk. 13,254.</p>
<p><i><strong>Fahmida Khatun- Director, Centre for Policy Dialogue <i><strong>Bangladesh </strong></i></strong></i>mentioned that Garment workers receive the lowest minimum wage among all major industrial sectors in Bangladesh, and there is constant pressure from buyers and manufacturers to keep wages down in order to ensure their own profits. Making matters worse are the subcontracting factories that compete with manufacturers for low cost, resulting in a race to the bottom that further contributes to the injustice.</p>
<p><strong>Victims and Activists shared their experiences</strong></p>
<p>Several victims from Rana Plaza and Tazreen Factories had the opportunity to share their experiences.  Activists who had been working with the garment factory victims spoke about the struggles with DNA Testing process, victim and rescuer support, compensation, health care etc.</p>

<p>The Barrister who feels strongly about non enforcement of existing laws in the garments industry context, <a href="http://www.newagebd.com/special.php?spid=16&amp;id=71">Jyotirmoy Barua, </a>spoke about the <a href="http://www.askbd.org/ask/2013/10/21/update-tazreen-factory-fire-victim-pending-justice/">writ petition he filed</a> against the Owner of Tazreen Fashions for criminal negligence. The writ was filed by three  anthropologists,  Naznin Akter Banu, Saydia Gulrukh Kamal and Mahmudul Hasan Sumon, seeking directives for the arrest of Tazreen’s owner Md Delwar Hossain to ensure his trial for criminal liabilities.</p>
<p>Barrister Jyotirmoy shared that, though a majority of the accidents in garment factories can be traced back to the deliberate negligence of factory owners, bribing, nepotism, case file disappearances, etc. have impeded arrest and proper trial of those guilty. In the case of the Tazreen Garments fire, owner Delwar Hossain is yet to face trial even after a Probe Committee report was submitted by the government acknowledging the deliberate negligence of the owner in ensuring safety standards, which made him eligible to be tried under criminal law.</p>
<p>He also informed that, in the most recent hearing for the writ petition, the High Court has ordered the government pay for the treatment of <a href="http://opinion.bdnews24.com/2013/09/15/sumaya-and-the-unconditional-cash-transfer/">Sumaiya Khatun</a>, a Tazreen factory worker who has developed cancer since her ordeal trapped inhaling fumes in the Tazreen fire. The government has yet to respond whilst her condition has been deteriorating rapidly while undergoing chemotherapy, she has lost her sight and hearing.</p>
<p>He concluded saying that until support from state and the legal system can be established, activists and human rights lawyers will continue to struggle to find justice, and crimes committed against garments workers will continue to go unpunished.</p>

<p><a href="http://www.globalpost.com/dispatches/globalpost-blogs/rights/bangladesh-labor-activist-tazreen-savar-factory-garment">Saydia Gulrukh</a>,<span style="color: #000000;"> one of the  panelists at the consultation, said that i</span>nstead of euphemising these incidents as “tragedies”, we should recognize them as acts of deliberate negligence and bring the relevant authorities to justice. Rescue and rehabilitation processes need to take into account the realities of the situation and limitations. Given the state of forensic science in Bangladesh, reliance on DNA tests is not an adequate or efficient way to determine compensation. Nor are one-time compensations sufficient to cover the cost of medical expenses of survivors with long-term health consequences.</p>
<p><span style="color: #000000;">She also emphasised the importance of the Bangladesh</span><span style="color: #000000;"> government ratifying the</span> <strong><span style="color: #0000ff;"><span style="color: #0000ff;"><a href="http://www.ilo.org/dyn/normlex/en/f?p=NORMLEXPUB:12100:0::NO::P12100_ILO_CODE:C121">ILO Convention C121 (click to view)</a>,</span></span></strong><span style="color: #000000;"> concerning &#8221;Benefits in the Case of Employment Injury&#8221; (Entry into force: 28 Jul 1967). She has been witnessing the problems which the victims and their families have had to face since the Tazreen Factory Fire, through to SMART fashions, Rana Plaza and the recent Aswad Composite Garments factory accidents. </span></p>

<p><a href="http://lightbox.time.com/2013/05/08/a-final-embrace-the-most-haunting-photograph-from-bangladesh/">Taslima Akhter</a>, a photojournalist and an active campaigner for workers rights from the <strong>Bangladesh Garment workers Solidarity</strong>, highlighted how the workers were not to blame if there was a dent in the garment industry of Bangladesh, it is the owners, building inspectors, BGMEA and the government who are to blame for not taking the necessary measures to meet their needs and empower them with the rights they are entitled to. She spoke of the garment workers in Bangladesh being perceived as the &#8221;cheapest&#8221; therefore disposable, hence the lack of value for their rights.</p>
<p>She also pointed out that we also need to be wary of the fact that trade unions are not the panacea to ensuring workers’ rights as union leaders are often controlled and bought off by factory owners, making it increasingly more difficult for workers to protest against violations without putting their jobs at risk.</p>
<p><i>Commenting on the testimonials of the garment workers, Khushi Kabir pointed out that the responsibility to act and address the highlighted concerns lies at all levels- with international bodies, governments, trade unions, owners, and citizens. Scarce employment opportunities have driven many women to work in this sector, but there is need to strengthen their bargaining power through trade unions. Workers should be granted the rights they deserve, but this does not need to come at the expense of threatening the industry.</i></p>

<p><strong><i>Recommendations from the Consultation</i></strong></p>
<ol>
<li>Government should follow international human rights standards since it is party to several international treaties protecting the rights of workers</li>
<li>Complaints should be launched to the Working Group by international bodies and grassroots organizations providing further information on these incidents so it can write to the government with recommendations on how to increase the effectiveness of its remedial efforts and prevent similar disasters from arising in the future.</li>
<li>Investment is needed from manufacturers, buyers and development partners to improve skill and efficiency of workers and to modernize factories with improved technology and working conditions, all of which will contribute towards increasing productivity.</li>
<li>These investments need to be carefully monitored to ensure accountability and transparency. In addition, subcontracting firms should be integrated into the supply chain in order to remedy the compliance and capacity issues of these factories.</li>
<li>The wage should be calculated on the basis of the take-home pay earned during normal working hours, without counting overtime that diminishes the workers’ health and well-being.</li>
<li>Existence of trade unions is vital.  Trade unions are a must if we want to guarantee the rights and security of workers and give them bargaining power. Fighting for workers’ rights for decent wage and working conditions would allow employers the chance to benefit from the increased buying power of workers, which in turn will increase the buying power of the entire economy

<li>The discrimination experienced by young women employed in this sector needs to be incorporated into the compensation system</li>
<li>Short-term priorities should include- a) publication of the probe committee report and DNA report in order to regain public trust and identify the accountable parties for the systemic violations, b) addressing the stigmatization of the men and women fighting for the rights of the victims as foreign agents, and c) necessity of discussing the UN Guiding Principles on Business and Human Rights with BGMEA representatives.</li>
<li>The civil society and the legal sector need to work together to create pressure on the authorities and the government to ensure workers’ rights. Responses should focus on improving working conditions rather than shifting the industry that plays such a vital role in the economic growth of Bangladesh.</li>
</ol>

The concerned authorities need to be wary and respectful of their duties as these recurring factory accidents are not isolated incidents, but direct results of continuous negligence and irresponsibility on their parts. The state needs to create pressure on the factory owners, who enjoy government facilities and access to public funds, to offer a living wage to their workers and thereby guarantee the right to healthy living to its constituents. Similarly, garment owners also need to be held responsible and accountable to citizens for the injustice and violations of workers’ rights. <p><strong>A Lawful Remedy to Death in Factories?<br />
</strong></p>
<p><em>Translation of article published in ASK Spring Bulletin</em></p>
<p class="MsoEndnoteText">On the 24th April 2013, with an abrupt tremor and piles of dust, the eight storey commercial building in Savar, Rana Plaza, collapsed. Approximately 2,238 injured people were rescued alive. The search for the dead ended on the 13th May with the death toll of 1,127, as declared by the government.  The Savar branch of BRAC Bank which was situated on the ground floor of Rana Plaza, had immediately closed and sent its staff home after cracks were discovered in the building.</p>
<p>Five garment factories decided to ignore the warnings given the day before, workers were forced to work despite the fear of cracks. Five months earlier, 112 workers were burned to death at the   Tazreen Fashion Factory in Nishchintapur, Ashulia on 24 Nov 2012, which reminded us of the 64 workers who were killed in the collapse of Spectrum Garments, Savar, in 2005.</p>
<p>The Bangladesh Institute of Labour Studies researchers found that in Bangladesh the factory death toll spanning  all sectors, has resulted in 6,406 deaths in the last twelve years.  Article 32 of the Constitution of Bangladesh, guarantees an undisputed right to life. Moreover, the 2006 Labour Law prescribes  a safe and proper workplace. Questions arise why the laws are not implemented.</p>
<p><strong>Spectrum Factory Fire | 11 April 2005</strong><br />
45 cases had been filed against the factory owners, Shahriar Sayeed Hassan and Abul Hashem Fakir, as informed by Sayeed Salahuddin Ahmed, the Asst. Managing Director of BILS. However, nothing could be known about the whereabouts of the accused owners.  ASK,  BLAST, BELA and Nijera Kori filed a writ petition, in which the High Court had given directions for investigations into the cause of the collapse. Hearing have been pending for seven  years.  The Attorney General, Mahbub Alam, admitted on16 May 2013 in “The Daily Star” of his ignorance of the petition but emphasized that he would take actions to settle it.</p>
<p><strong>KTS Textiles | 23 Feb 2006</strong><br />
The Factory caught fire with a huge blast as the generators were running with no electric supply. Each floor was locked along with the main entrance, the only staircase was blocked with bales of garments, which led to 57 workers’ burning to death. The building had no emergency exit.</p>
<p><span style="color: #ff6600;">ASK and BLAST filed a writ petition. The High Court ordered an enquiry and issued a show-cause notice to the ones responsible to define the cause and to state the preventive measures taken later. Moreover, the court claimed to ascertain the compensations given to the victims. In 2010, the petitioner sent them a notice on their disgracing the High Court, as for the last four years, the KTS party had paid no heed to the writ. Overall, the case faced no advancement from then.</span></p>
<p><strong>Tazreen Fashions Ltd Factory Fire 24th November 2012</strong></p>
<p class="MsoEndnoteText"><span style="color: #ff6600;">Police filed a litigation blaming outside imposters who intentionally set the fire.</span><br />
<span style="color: #ff6600;"> The irony is, like earlier cases, the factory lacked adequate fire exits, the doorways had been locked shut and there was no emergency exit, leaving no way out. Chilling photographs from the scene show how the fire extinguishers were all intact, unused because staff had not been trained to use them. These were the initial facts which were found upon investigation, which directly holds the owner of the factory to be solely responsible for the 112 deaths through criminal negligence.</span></p>
<p>Observers guessed that the police omitted these facts so the owner was not held responsible as the litigation had no hint of the owners name.  The Home Ministry and the Ministry of Labour categorically recommended to file a case for this incident but so far no action has been taken. Moreover, the Home Minister Mohiuddin Khan Alamgir produced a number of arguments not to arrest the owner of Tazreen Fashion&#8217;s, Mr. Delowar Hossain.  On this issue, ASK, in collaboration with BLAST, BRAC and Nijera Kori had put a writ petition at the High Court and the Court issued a rule.</p>
<p>To be noted that the Court, then, issued an order to the Tazreen Garments Ltd and Tuba Group Managing Director to submit to the steps taken to compensate the victims to the court. The Court summoned the owner on the 13th May 2013, as they he had not replied earlier. The Tazreen Fashions Ltd owner presented a victim list the same day.  He also submitted a report on how compensations were being paid. Beside this, the High Court ordered that the Home Ministry, along with the Ministry of Labour, BD Police and Fire Service to submit the investigation report within next two weeks following.</p>
<p>Also on the 26th of November 2012 rule, two days after the incident, the Court had ordered NHRC to produce a list of a ten member investigation committee lead by an ex-Judge. Unfortunately, the submission of the committee list had taken 155 days, to which the High Court expressed sheer agitation.</p>
<p>ASK, allied with BLAST put a writ petition on 25 April 2013, to make an in-depth inquiry on Savar Tragedy, to secure proper implementation of building code to avoid such repetitions in future and to ascertain a garment worker’s right to live a secure life as well as a right to legal shelter.</p>
<p>The Hearing took place on 29th Apil 2013.  The Petitioners produced a Daily Star Report before the Court with the reference to the chairperson of RAJUK, the government administration responsible for the planning, permission, building regulation and land management of the city of Dhaka, the chairperson of Rajuk mentions in the report that despite being located in Savar, they were incapable of taking necessary steps. The petitioner expressed his view to punish the accused parties of Spectrum and Tazreen to hinder these repetitions and further deaths in the future</p>
<p>Recently there has been revolt prevailing among the garment workers since the unreasonable factory deaths due to building code and law violations. As such, the writ petitioners claimed for the Court’s intervention for a combined and regulated progress. They also put an appeal to mark the reasons behind the occurrences, to rehabilitate the living survivors, to compensate the victims and to ensure the guilty undergo trial to secure necessary remedy.</p>
<p>The basic rights bestowed upon the workers in the sections 31 and 32 of the Constitution, as well as in the Labour Law 2006, have been violated at the failure of the owners. As a result, the petitioners besought to take initiatives against the owners, according to the penal code and Labour Law 2006. An appeal for summoning Sohel Rana and the other owners to the Court to explain their accountabilities were made as well.</p>
<p>During the hearing, Attorney General Mahbub-e-Alam, on behalf of the government, informed that Sohel Rana and others had been arrested. He announced a proposal of budgeting approximately 600 million Bangladesh taka for the survivors and victims families, 1 million for each. He also shared his personal opinion, which was to collect the half money from the building owner and the other half from the factory owners.</p>
<p>The Court, after the hearing, issued a rule to the owners to submit answers as to why they would not be brought to proper inquiry and legal actions within seven days. Moreover, why there would not be any indemnity for the suffering families or, why they would not be rehabilitated was likely to be answered as well. The court gave a notice to forclose all the bank accounts belonging to the owners from which salaries and other indemnities could be drawn for the workers. On 30 April 2013, the Court summoned Sohel Rana and the factory owners.  The following Hearing held on the 13 May 2013, when the Court sent a notice to the Mayor (acting) of Savar City Corporation to submit all the Rana Plaza papers, equipped with the list of the relatives living locally and also with the identity, appointment letter and photos of the victims.</p>
<p>A litigation on factory deaths, filed in 1997 at the High Court had been settled in 2001, though no recent suit faced the same. The Spectrum, Tazreen and Rana Plaza lawyer,Barrister Sara Hossain, attended an interview by The Daily Star dated 3 May 2013. She alleged that the thin monitoring by the govt and the highly packed lines of litigations were the possible reasons behind the repeated failure to address this problem. She mentioned how ann in-depth union between the government and the bench of the Chief Juctice was necessaryShe suggested that the Home Ministry catalogue these suits as super-sensitve and to fast track these cases under a quick trial. On the other hand, Nipendranath Das, the acting Deputy-Head of the Factory Inspection Dept in the Dhaka district, said to The daily Prothom AloWe have only 17 inspectors, they are assigned to inspect 16,000 factories. So, despite our profound willingness, we cannot go through all the factories.” The confusions arises, as to why the government is not appointing more inspectors even after facing these type of accidents so often.</p>
<p>Death at workplaces, especially at garment factories are being accepted as an everyday occurrence. In 1997, ASK pleaded for a writ to determine the workers’ life-security. The High Court issued an order to form a national inspection committee and a five-paragraph notice was sent to the govt with no positive consequences.</p>
<p>Some more suits had been filed at the Court of Labour from time to time to extort compensations for the victims. No less than 91 ligitations of this sort had been filed in between 2008 and 2013, among which only 47 were settled. Compensations had come from 19 suits. At present, 47 litigations are waiting to be solved.</p>
<p>Death in garment factories result from criminal negligence in the implementation and inspection of laws. Moreover, the Government cabinet’s reluctance and the life long legal procedures stall the chances for the victims to get legal remedy, thus making justice a far cry.</p>

										<content:encoded><![CDATA[<p><strong>The Psycho Social Counseling (PSC) Unit from ASK teamed up with the Department of Educational and Counseling Psychology of Dhaka University created a Support unit with trained counselors to provide psychological assistance to the injured survivors of Rana Plaza disaster in Savar.</strong></p>
<p><a href="u"><img loading="lazy" decoding="async" class="alignright size-full wp-image-798" alt="" src="http://www.askbd.org/ask/wp-content/uploads/2013/06/Rescu.jpg" width="448" height="299" srcset="https://www.askbd.org/ask/wp-content/uploads/2013/06/Rescu.jpg 448w, https://www.askbd.org/ask/wp-content/uploads/2013/06/Rescu-300x200.jpg 300w" sizes="auto, (max-width: 448px) 100vw, 448px" /></a>The team has been working with survivors of the disaster since 25<sup>th</sup> April at Enam Medical College Hospital, and CMH Savar.  They worked with more patients who were transferred to  Dhaka Orthopedics Hospital and Sohrawardy Hospital.</p>
<p>After the patients became a little stable after their injury, ASK counselors  provided a regular schedule of treatment.</p>
<p>225 of the patients who have been treated by ASK PSC had been traumatised in addition to their physical injury. Symptoms included insomnia, breathing problems, flashbacks, fear, sadness, fear for the future.</p>
<p><a href="C"><img loading="lazy" decoding="async" class="size-full wp-image-799 alignleft" alt="look" src="http://www.askbd.org/ask/wp-content/uploads/2013/06/look.jpg" width="448" height="299" srcset="https://www.askbd.org/ask/wp-content/uploads/2013/06/look.jpg 448w, https://www.askbd.org/ask/wp-content/uploads/2013/06/look-300x200.jpg 300w" sizes="auto, (max-width: 448px) 100vw, 448px" /></a>ASK is also proving counseling support to family members and those who are receiving follow up services through Bangladesh Institute of Labour Services (BILS) health centre at Savar, near Rana Plaza. BILS is  providing comprehensive support through a collective effort between doctors, physiologists, psychiatrists and counselors.</p>
<p>After observing the need for psychological therapy for rescuers through the media, ASK Psycho Social Counseling (PSC) unit offered counseling support to different organisations  which participated in the rescue operation.</p>
<p>The Fire Service and Civil Defense department expressed their need to work with professional staff and volunteers. PSC counselors decided to start group therapy from the 6th of June at ASK. Around 200 staff and volunteers will participated in the group therapy as well as counseling on an individual basis if need be. <img loading="lazy" decoding="async" class="alignright size-full wp-image-802" alt="DSC_0062" src="http://www.askbd.org/ask/wp-content/uploads/2013/06/DSC_0062.jpg" width="448" height="298" srcset="https://www.askbd.org/ask/wp-content/uploads/2013/06/DSC_0062.jpg 448w, https://www.askbd.org/ask/wp-content/uploads/2013/06/DSC_0062-300x199.jpg 300w" sizes="auto, (max-width: 448px) 100vw, 448px" /></p>
<p>In addition to this, those who were involved in the rescue operations have been receiving one to one support  or on the phone. <p class="MsoNormal" style="text-align: justify;"><strong><span style="font-size: 11pt; font-family: 'Arial','sans-serif';">28th April, 2013</span> |</strong> <span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333; background: white;">The High Court today directed the Bangladesh Bank to issue a circular on concerned commercial banks imposing restrictions on withdrawal or transfer of money by the owners of Rana Plaza in Savar and by owners of the five RMG factories located there. It noted that the salaries of the workers should nevertheless be paid from these accounts under BGMEA’s supervision.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-pagination: none; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333; background: white;">The HC also issued a Rule Nisi on the concerned authorities asking them to show cause why the collapse victims should not be compensated and why legal action should not be taken against the persons involved. The Court summoned the chief factory inspector</span><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #3c3c3c; mso-fareast-language: EN-US;">, the director of industrial police in Savar zone, and the local government officer (the Upazila Executive Officer (UNO) to appear before it.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #3c3c3c; mso-fareast-language: EN-US;">The Court also ordered the Inspector General of Police to submit a report before it within seven days on what legal steps the government has taken after the collapse of Spectrum building in 2005, Phoenix building in 1997 and <span style="mso-spacerun: yes;"> </span>the fire in Tazreen Fashions Ltd in 2013.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333; background: white;">A Division Bench of the High Court, comprising Justice Mirza Hossain Haider and Justice Muhammad Khurshid Alam, passed the order today in a writ petition filed on behalf of the Bangladesh Legal Aid and Services Trust (BLAST) and Ain o Salish Kendra (ASK).</span><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif';"> Advocate ZI Khan Panna, represented BLAST and ASK in Writ Petition No.4390/2013, with Advocate Shahnaj Babli, Advocate Khondoker Shahriar Shakir, Advocate Qazi Zahed Iqbal, Advocate Abantee Nurul and others. Deputy Attorney General AL Amin Sarker and Assistant Attorney General K B Masud Rumi appeared for the Government.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-layout-grid-align: none; text-autospace: none;"><b style="mso-bidi-font-weight: normal;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif'; color: #333333; background: white;">Background:</span></b><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif';">On Thursday 25 April 2013, the Rana Plaza in Savar collapsed suddenly after developing cracks, causing the death to date of more than 300 people with many more injured and countless others remaining trapped in the wreckage.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif';">On the reporting of this incident, a High Court Division bench comprising Mr. Justice Mirza Hossain Haider and Mr. Justice Md Khurshid Alam issued a Suo Motu rule on 25 April 2013.</span></p>
<p class="MsoNormal" style="text-align: justify; mso-layout-grid-align: none; text-autospace: none;"><span style="font-size: 11.0pt; font-family: 'Arial','sans-serif';">The High Court has earlier issued directions and orders on the Government to take action in cases of building collapses resulting in the deaths of scores of citizens. For example, in 2005 after the Polashbari incident, it directed the concerned authorities to show cause why they should not establish an independent Commission to inquire into the incident, and protect the victims and their families. In this earlier order, the Court had directed the building owner and the concerned RMG factory owners to submit a list of their accounts and to allow the victims and their families to enforce their legal right to compensation and further restrained them from disposing of any of their assets and properties to frustrate the realization of compensation by the victims and families till disposal of the Rule. That Rule was made returnable within three weeks.<span style="mso-spacerun: yes;">  </span>No action appears to have been taken to date.</span></p>

<p><b><span style="text-decoration: underline;">Cause Title</span></b></p>
<p>Failure of the respondents to ensure effective enforcement of applicable laws on building construction and workplace safety, in particular, failure to prevent deaths of and injuries of garment workers and other people from collapse of the nine-storey building namely Rana Plaza, in Savar, Dhaka amounting to breach of statutory duties and gross negligence of the respondents.</p>
<p><b><span style="text-decoration: underline;">Prayer</span></b></p>
<p>Wherefore it is most numbly prayed that your Lordships may graciously be pleased to:</p>
<p>(A) Issue a Rule Nisi calling upon the respondents to show cause as to why they should not be directed to take necessary action as required by the law and the Constitution to effectively investigate, prosecute and punish those responsible for the deaths and injuries to the victims of the building collapse on 24.04.2013 at Savar, Dhaka and to take all necessary measures for such purpose and for prevention of any future such occurrence, including:</p>
<p>(i)           To secure payment by the respondents of adequate compensation to the victim workers and their families, who have died or have suffered injury in the said building collapse.</p>
<p>(ii)          To ensure appropriate protective measures in particular safety precautions in the event building collapse and to implement and enforce legal provisions for the rehabilitation of the victims of such incidents as well as making available appropriate medical treatment for victims of building collapse.</p>
<p>(iii)        To direct the respondent Nos. 4 to 6 to produce the respondent Nos. 6 to 9 before this Hon’ble Court on a particular day to clarify their responsibilities.</p>
<p>(B)     Pending hearing of the rule, pass interim orders</p>
<p>i)             To directly the respondent Nos. 3-5 to produce the respondent Nos. 7 to 11 before this Hon’ble Court on a particular day to clarify their responsibilities;</p>
<p>ii)         To direct the respondents to ensure immediate rescue of the victims and also ensure proper treatment at their responsibility, costs and expenses;</p>
<p>iii)     To direct the respondent No. 7 owner of the building to produce before the court necessary approvals in respect of the aforesaid collapse building within a stipulated period of time;</p>
<p>iv)        To direct the respondent Nos. 1-6 to intimate the Hon’ble Court about the steps they have taken meanwhile in respect of the victims.</p>
<p>(C) After perusing the causes, if any show and haring the parties make the rule absolute.</p>
<p>(D) Cost of and incidental to this applicant be directed to be born by respondents.</p>
<p>(E) any other or further order orders as may be deemed fit and proper be also granted.</p>
