Ain o Salish Kendra (ASK) expresses its condemnation and concern over the arrest of an individual named Golam Mostafa in Parbatipur, Dinajpur, under the Cyber Security Act on allegations of making derogatory remarks about BNP Chairperson Tarique Rahman on social media.<\/p>\n
According to media reports, a local BNP leader filed a case under the Cyber Security Act at Parbatipur Model Police Station on 21 January 2026, alleging that Golam Mostafa had made negative comments about BNP Chairperson Tarique Rahman on Facebook. However, prior to the filing of the case, police detained Golam Mostafa on the night of 20 January 2026 and took him to the police station. After being held at the police station overnight, he was produced before the court the following day based on the filed case and the court ordered that he be sent to jail.<\/p>\n
ASK believes that freedom of expression is a fundamental right recognised by the Constitution of Bangladesh. Article 39 of the Constitution guarantees citizens\u2019 freedom of thought, conscience and expression. Criticism, discussion, or the expression of dissenting opinions regarding political figures and public leaders is a natural and essential feature of a democratic society. In the past and present, both domestically and internationally, criticism of politicians, debates in the media and the publication of satirical cartoons have long been regarded as integral elements of democratic culture.<\/p>\n
A few days prior to this incident, in Dhaka, a teacher named Shahidul Islam, who was employed at a technical training centre, was detained by BNP leaders and activists and handed over to Shahbagh Police on allegations of making derogatory remarks about Tarique Rahman during a visit to Osman Hadi\u2019s grave. Police showed his arrest under Section 54 of the Penal Code and sent him to jail through the court. Subsequently, the court granted him bail. It is noteworthy that BNP later issued a statement demanding his release and stated that arrest and imprisonment for exercising freedom of expression was not appropriate.<\/p>\n
In recent years, many citizens have been arrested, imprisoned and harassed under restrictive laws such as the Digital Security Act on allegations of making derogatory remarks about politicians. Such practices create a culture of fear in society and shrink the space for free expression. The tendency to immediately bring political discussions or comments under criminal prosecution reflects an overzealous approach to law enforcement, which is inconsistent with a democratic system of governance.<\/p>\n
ASK further believes that responding to dissent or criticism through political engagement strengthens democracy, whereas resorting to lawsuits and imprisonment narrows the political space. ASK also expects greater tolerance, restraint and democratic conduct from political leadership and political parties.<\/p>\n
