Six special tribunals will be set in six divisions to hold the trial. Several newspapers published this news on 22nd October 2009. The minister also said that the BDR personnel charged with mutiny would be allowed to appoint lawyers, but the lawyers would only provide counsel to the accused BDR members and not be able to take part in the arguments. Ain o Salish Kendra (ASK) thinks this will be a serious violation of the applicability of the existing laws and it can be a serious impediment to the justice to BDR members.<\/p>\n<p>Section 10(3) of BDR Act-1972 states- \u2018any BDR member accused under the law can defend himself, by any officer or with the assistance of any lawyer.\u2019 The section does not mean that a lawyer assisting any accused will not be able to take part in argument. Rather as per the recognised legal procedure and the Criminal Procedure Code, we know, a lawyer\u2019s assistance means his or her participation in arguments as well. Moreover, the law minister did not say clearly whether the trial would be held publicly.<\/p>\n<p>ASK urge the Government to follow the recognized legal procedure to uphold the rights of the accused BDR members to defend themselves during the trial. If lawyers appointed by them are not able to take part in arguments, it will be a clear violation of Article 31 of the constitution that guaranteed \u2018equal protection of law\u2019.<\/p>\n<p>ASK hope that the government would show due respect to the constitutional provision and ensure transparent and impartial trial process for the accused BDR personnel.
