অধিকার, মর্যাদা ও সমতায় এখনো অনেক পথ বাকিঃ আইন ও সালিশ কেন্দ্র (আসক)

৮ মার্চ আন্তর্জাতিক নারী দিবস। বিশ্বব্যাপী নারী অধিকার, মর্যাদা ও সমতা প্রতিষ্ঠার সংগ্রামকে স্মরণ ও নতুন করে অঙ্গীকার করার এই দিনটি বাংলাদেশের প্রেক্ষাপটেও গভীর তাৎপর্য বহন করে। দেশের স্বাধীনতা সংগ্রাম থেকে শুরু করে রাষ্ট্র নির্মাণ, অর্থনৈতিক উন্নয়ন ও সামাজিক অগ্রগতির প্রতিটি পর্যায়ে বাংলাদেশের নারীরা গুরুত্বপূর্ণ ও গৌরবময় অবদান রেখে চলেছেন।

বাংলাদেশের  স্বাধীনতা যুদ্ধে নারীরা যেমন নির্যাতন, আত্মত্যাগ  ও সাহসিকতার এক অনন্য ইতিহাস সৃষ্টি করেছে, তেমনি স্বাধীনতা-উত্তর রাষ্ট্র গঠনেও তাদের সক্রিয় অংশগ্রহণ দেশের অগ্রযাত্রাকে ত্বরান্বিত করেছে। কৃষি, পোশাক শিল্প, শিক্ষা, স্বাস্থ্য, স্থানীয় সরকার, ব্যক্তি উদ্যোক্তা কার্যক্রম এবং প্রবাসী আয়ে নারীর অবদান আজ বাংলাদেশের অর্থনৈতিক ও সামাজিক উন্নয়নের এক গুরুত্বপূর্ণ ভিত্তি। শিক্ষা ও কর্মক্ষেত্রে নারীর অংশগ্রহণ বৃদ্ধি এবং নীতি পর্যায়ে নারীর উপস্থিতি যা গত কয়েক দশকে ইতিবাচক পরিবর্তনের বলিষ্ঠ উদাহরন।

তবে এই অগ্রগতির পাশাপাশি বাস্তবতা হচ্ছে-বাংলাদেশে নারী ও কন্যাশিশুর অধিকার এখনো নানামাত্রিক চ্যালেঞ্জের মুখে রয়েছে। নারী ও কন্যাশিশুর বিরুদ্ধে সহিংসতা, ধর্ষণ ও যৌন নিপীড়ন, বাল্যবিবাহ, মানবপাচার, পারিবারিক সহিংসতা এবং অনলাইন সহিংসতা উদ্বেগজনকভাবে অব্যাহত রয়েছে। অনেক ক্ষেত্রে ভুক্তভোগীরা সামাজিক প্রতিবন্ধকতা, ভয় ও বিচারপ্রক্রিয়ার দীর্ঘসূত্রিতার  কারণে ন্যায়বিচার থেকে বঞ্চিত হন। একই সঙ্গে অর্থনৈতিক বৈষম্য, নিরাপদ কর্মপরিবেশের অভাব এবং সিদ্ধান্ত গ্রহণ প্রক্রিয়ায় নারীর সীমিত অংশগ্রহণ নারীর ক্ষমতায়নের পথে গুরুত্বপূর্ণ বাধা হয়ে আছে।

সাম্প্রতিক সময়ে দেশের বিভিন্ন পরিসরে এবং সামাজিক যোগাযোগ মাধ্যমে নারী অধিকার বিষয়ে কিছু গোষ্ঠীর পক্ষ থেকে নারী বিদ্বেষমূলক বক্তব্য ও আচরণের বহিঃপ্রকাশ লক্ষ্য করা যাচ্ছে, যা গভীর উদ্বেগের বিষয়। নারীর পোশাক, চলাফেরা এবং ব্যক্তিস্বাধীনতা নিয়ে অবমাননাকর মন্তব্য ও এমন কিছু বক্তব্য প্রকাশিত হচ্ছে যা নারীর মৌলিক অধিকার এবং মর্যাদাকে প্রশ্নবিদ্ধ করে। যদিও এ ধরনের দৃষ্টিভঙ্গি বাংলাদেশের সংখ্যাগরিষ্ঠ মানুষের মূল্যবোধের প্রতিফলন নয়, তবুও এ ধরনের প্রবণতা সমাজে বৈষম্য ও সহিংসতার সংস্কৃতিকে উৎসাহিত করতে পারে। আইন ও সালিশ কেন্দ্র (আসক) মনে করে, সংবিধান প্রদত্ত সমতা, মর্যাদা ও স্বাধীনতার নীতির আলোকে নারী বিদ্বেষমূলক বক্তব্য ও আচরণের বিরুদ্ধে সামাজিক ও প্রাতিষ্ঠানিকভাবে দৃঢ় অবস্থান নেওয়া জরুরি।

বাংলাদেশের সংবিধান নারী-পুরুষের সমতা ও বৈষম্যহীনতার সুস্পষ্ট অঙ্গীকার করেছে। সংবিধানের ২৭, ২৮ ও ২৯ অনুচ্ছেদে আইনের দৃষ্টিতে সমতা, লিঙ্গভিত্তিক বৈষম্য নিষিদ্ধকরণ এবং রাষ্ট্রীয় সুযোগ-সুবিধায় সমান অধিকার নিশ্চিত করার কথা বলা হয়েছে। একই সঙ্গে বাংলাদেশ আন্তর্জাতিক অঙ্গনে নারী অধিকার সুরক্ষায় গুরুত্বপূর্ণ বিভিন্ন চুক্তি ও সনদে অঙ্গীকারাবদ্ধ। নারী বৈষম্য বিলোপ সনদ (সিডও), শিশু  অধিকার সনদ এবং টেকসই উন্নয়ন লক্ষ্যমাত্রা (এ স ডিজি) বাস্তবায়নের মাধ্যমে নারী ও কন্যাশিশুর অধিকার নিশ্চিত করার প্রতিশ্রুতি রাষ্ট্র গ্রহণ করেছে।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, নারীর অধিকার নিশ্চিত করতে আইন প্রণয়নের পাশাপাশি তার কার্যকর বাস্তবায়ন অত্যন্ত জরুরি। সহিংসতার শিকার নারীর জন্য সহজপ্রাপ্য ও ভুক্তভোগীবান্ধব বিচারপ্রক্রিয়া নিশ্চিত করা, আইন প্রয়োগকারী সংস্থার জবাবদিহিতা জোরদার করা, বাল্যবিবাহ ও মানবপাচার প্রতিরোধে কার্যকর পদক্ষেপ গ্রহণ, কর্মক্ষেত্রে নিরাপত্তা ও মর্যাদা নিশ্চিত করা এবং শিক্ষা ও অর্থনৈতিক সুযোগে নারীর সমান প্রবেশাধিকার নিশ্চিত করা সময়ের গুরুত্বপূর্ণ দাবি।

আন্তর্জাতিক নারী দিবস উপলক্ষে আইন ও সালিশ কেন্দ্র (আসক) মনে করে, নারীর অধিকার, মর্যাদা ও নিরাপত্তা নিশ্চিত করা কেবল একটি উন্নয়নমূলক লক্ষ্য নয়; এটি একটি ন্যায়ভিত্তিক, মানবিক ও গণতান্ত্রিক রাষ্ট্র প্রতিষ্ঠার মৌলিক শর্ত। নারী ও কন্যাশিশুর প্রতি বৈষম্য ও সহিংসতামুক্ত একটি সমাজ গড়ে তুলতে রাষ্ট্র, নাগরিক সমাজ এবং সকল মানুষের সম্মিলিত ও দায়বদ্ধ উদ্যোগ অপরিহার্য।

Media reports indicate that written instructions issued by the Bangladesh Police at the Rajshahi Range level direct the re-arrest of bail-released individuals on the grounds of their “capacity to strengthen or organise the party.” Such directives contradict the rule of law, personal liberty, and fundamental principles of justice. It is the responsibility of the State to take action against any citizen only through lawful procedures based on specific allegations and evidence. Any planned harassment or re-arrest based on preconceptions violates both legal norms and democratic practices.

ASK notes that it is unclear on what legal authority and accountability basis the police leadership relies to issue such directives. Such measures are wholly inconsistent with the commitments of a newly elected government to good governance, human rights protection, and accountability at all levels. As a government begins its democratic journey through the exercise of the people’s voting rights, all state organs, particularly law enforcement agencies, have heightened obligations to act in accordance with the Constitution and human rights standards.

ASK firmly believes that the Constitution of Bangladesh and international human rights instruments guarantee citizens’ freedom, justice, and equal protection under the law. While it is necessary to take lawful action against any citizen with credible allegations, no one has the authority to harass individuals intentionally.

ASK strongly urges the immediate disclosure of the legal basis of the relevant directives, review of all associated orders and procedures, and measures to ensure compliance with the Constitution and international human rights standards. ASK also calls for effective steps to end illegal arrests, harassment, and practices such as “show-arrest,” ensuring citizens’ access to justice, personal liberty, and equal protection under the law.

কার্যক্রম নিষিদ্ধ রাজনৈতিক দলের নেতা-কর্মীদের বিরুদ্ধে পুলিশের ‘অবস্থা বুঝে ব্যবস্থা’ ও পুনরায় গ্রেপ্তারের নির্দেশনা জারীর বিষয়ে আইন ও সালিশ কেন্দ্র(আসক) এর গভীর উদ্বেগ

সাম্প্রতিক গণমাধ্যমে প্রকাশিত সংবাদে জানা গেছে যে কার্যক্রম নিষিদ্ধ একটি রাজনৈতিক দলের নেতা-কর্মীদের বিরুদ্ধে “অবস্থা বুঝে ব্যবস্থা”নেওয়ার নির্দেশনা মাঠপর্যায়ের পুলিশ কর্মকর্তাদের দেওয়া হয়েছে এবং জামিনে মুক্তিপ্রাপ্ত ব্যক্তিদের ক্ষেত্রে ‘শ্যোন-অ্যারেস্ট ‘ বা অন্য মামলায় পুনরায় গ্রেপ্তার দেখানোর নির্দেশও প্রদান করা হয়েছে। যা আইনের শাসন ও মানবাধিকার পরিপন্থী বলে মনে করছে আইন ও সালিশ কেন্দ্র (আসক)।

গণমাধ্যমে প্রকাশিত সংবাদ অনুযায়ী, বাংলাদেশ পুলিশ এর রাজশাহী রেঞ্জ পর্যায়ের লিখিত নির্দেশনায় জামিনপ্রাপ্ত ব্যক্তিদের “দলকে শক্তিশালী বা সংগঠিত করার সক্ষমতা” বিবেচনায় পুনরায় গ্রেপ্তার দেখানোর কথা বলা হয়েছে। এ ধরনের নির্দেশনা আইনের শাসন, ব্যক্তিস্বাধীনতা এবং ন্যায়বিচারের মৌলিক নীতির সঙ্গে সাংঘর্ষিক। কোনো নাগরিকের বিরুদ্ধে সুনির্দিষ্ট অভিযোগ ও প্রমাণ থাকলে আইনানুগ প্রক্রিয়ায় ব্যবস্থা নেওয়া রাষ্ট্রের দায়িত্ব; কিন্তু পরিকল্পিতভাবে হয়রানি বা পূর্বধারণার ভিত্তিতে পুনরায় গ্রেপ্তার আইনি ও গণতান্ত্রিক চর্চার পরিপন্থী।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, পুলিশ কর্তৃপক্ষ এ ধরনের সিদ্ধান্ত গ্রহণের ক্ষেত্রে তাদের এখতিয়ার ও জবাবদিহিতার ভিত্তি কী-তা স্পষ্ট নয়। একটি নবনির্বাচিত সরকারের সুশাসন প্রতিষ্ঠা, মানবাধিকার সুরক্ষা এবং সর্বস্তরে জবাবদিহিতা নিশ্চিত করার অঙ্গীকারের সঙ্গে এমন পদক্ষেপ সম্পূর্ণভাবে সাংঘর্ষিক। জনগণের ভোটাধিকার প্রয়োগের মাধ্যমে একটি গণতান্ত্রিক সরকারের যাত্রা শুরু হয়েছে, এই প্রেক্ষাপটে রাষ্ট্রের প্রতিটি বিভাগ, বিশেষ করে আইনশৃঙ্খলা রক্ষাকারী বাহিনীর ওপর সংবিধানসম্মত ও মানবাধিকারসম্মত আচরণের দায়বদ্ধতা আরও বেশি।

আইন ও সালিশ কেন্দ্র (আসক) দৃঢ়ভাবে বিশ্বাস করে, বাংলাদেশ সংবিধান এবং আন্তর্জাতিক মানবাধিকার সনদসমূহ নাগরিকের স্বাধীনতা, ন্যায়বিচার ও আইনের সমান সুরক্ষার নিশ্চয়তা প্রদান করে। কোনো নাগরিকের বিরুদ্ধে অভিযোগ থাকলে আইন অনুযায়ী ব্যবস্থা নেওয়া যেমন জরুরি, তেমনি কাউকে উদ্দেশ্যপ্রণোদিতভাবে হয়রানি করার এখতিয়ার কারো নেই।

আইন ও সালিশ কেন্দ্র (আসক) অবিলম্বে সংশ্লিষ্ট নির্দেশনার আইনি ভিত্তি জনসম্মুখে প্রকাশ, এ সংক্রান্ত সকল আদেশ ও প্রক্রিয়া পর্যালোচনা এবং সংবিধান ও আন্তর্জাতিক মানবাধিকার মানদণ্ডের সঙ্গে সামঞ্জস্যপূর্ণ ব্যবস্থা নিশ্চিত করার জোর দাবি জানাচ্ছে। একই সঙ্গে বেআইনি গ্রেপ্তার, হয়রানি বা “শ্যোন-অ্যারেস্ট”-এর মতো চর্চা বন্ধ করে নাগরিকের ন্যায়বিচার, ব্যক্তিস্বাধীনতা ও আইনের সমান সুরক্ষা নিশ্চিত করতে কার্যকর পদক্ষেপ গ্রহণের আহ্বান জানাচ্ছে।

According to media reports and video footage circulated on social media, police physically assaulted journalists while they were carrying out their professional duties. It has also been alleged that despite identifying himself as a university student, an individual was severely beaten with batons and subjected to punches and physical assault in the presence of a senior police officer. Such conduct reflects a highly unprofessional attitude and is contrary to the minimum standards of conduct expected from law enforcement agencies.

ASK believes that excessive or unreasonable use of force cannot be justified under the pretext of conducting anti-narcotics operations. Obstructing journalists from performing their professional responsibilities and engaging in violent behaviour against students constitute clear violations of citizens’ rights and the fundamental right to personal security.

ASK strongly demands a prompt, impartial and transparent investigation into the incident and calls for appropriate legal action against the police officials found responsible. ASK also urges the relevant authorities to provide clear instructions to members of the police force to refrain from unexpected and unacceptable conduct involving the use of force and to ensure effective oversight in this regard.

ASK believes that public trust can only be strengthened through respect for the rule of law and human rights. The organisation further calls upon the concerned authorities to ensure accountability in this incident and to take effective measures to prevent the recurrence of similar incidents in the future.

সোহরাওয়ার্দী উদ্যানে সাংবাদিক ও শিক্ষার্থীদের ওপর পুলিশের অপ্রত্যাশিত বলপ্রয়োগের ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) এর উদ্বেগ ও নিন্দা

সম্প্রতি রাজধানীর সোহরাওয়ার্দী উদ্যানে পরিচালিত মাদকবিরোধী অভিযানের সময় সাংবাদিক ও ঢাকা বিশ্ববিদ্যালয়-এর শিক্ষার্থীদের ওপর পুলিশের বলপ্রয়োগ ও মারধরের ঘটনায় আইন ও সালিশ কেন্দ্র (আসক)গভীর উদ্বেগ ও তীব্র নিন্দা জানাচ্ছে।

গণমাধ্যমে প্রকাশিত প্রতিবেদন ও সামাজিক যোগাযোগমাধ্যমে প্রচারিত ভিডিওচিত্রে দেখা যায়, পেশাগত দায়িত্ব পালনকালে উপস্থিত সাংবাদিকদের শারীরিকভাবে আঘাত করেছে পুলিশ। একইসঙ্গে বিশ্ববিদ্যালয়ের শিক্ষার্থী পরিচয় দেওয়ার পরেও একজন ঊর্ধ্বতন কর্মকর্তার উপস্থিতিতে সংশ্লিষ্ট শিক্ষার্থীকে বেধড়ক লাঠিপেটা ও কিল-ঘুষি মারার ঘটনা ঘটেছে বলে অভিযোগ উঠেছে। এ ধরনের আচরণ চরম অপেশাদার মনোভাবের বহিঃপ্রকাশ এবং আইনশৃঙ্খলা রক্ষাকারী বাহিনীর ন্যূনতম আচরণবিধির পরিপন্থী।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, মাদকবিরোধী অভিযান পরিচালনার নামে কোনোভাবেই অতিরিক্ত বা অযৌক্তিক বলপ্রয়োগ গ্রহণযোগ্য হতে পারে না। সাংবাদিকদের পেশাগত দায়িত্ব পালনে বাধা প্রদান এবং শিক্ষার্থীদের সঙ্গে সহিংস আচরণ নাগরিক অধিকার ও ব্যক্তির নিরাপত্তার অধিকারের সুস্পষ্ট লঙ্ঘন।

আইন ও সালিশ কেন্দ্র (আসক) এই ঘটনার নিরপেক্ষ, স্বচ্ছ ও দ্রুত তদন্তের জোর দাবি জানাচ্ছে এবং দায়ী পুলিশ কর্মকর্তাদের বিরুদ্ধে আইনানুগ পদক্ষেপ গ্রহণের আহ্বান জানাচ্ছে। একইসঙ্গে সংশ্লিষ্ট কর্তৃপক্ষের প্রতি অনুরোধ জানাচ্ছে, পুলিশ বিভাগের সদস্যদের বলপ্রয়োগের মতো অপ্রত্যাশিত ও অগ্রহণযোগ্য আচরণ থেকে বিরত থাকার বিষয়ে সুস্পষ্ট নির্দেশনা প্রদান ও কার্যকর তদারকি নিশ্চিত করা হোক।

আইন ও সালিশ কেন্দ্র (আসক) বিশ্বাস করে, আইনের শাসন ও মানবাধিকারের প্রতি শ্রদ্ধা প্রদর্শনের মাধ্যমেই কেবল নাগরিক আস্থা সুদৃঢ় করা সম্ভব। পাশাপাশি এ ঘটনায় যথাযথ জবাবদিহি নিশ্চিত করে ভবিষ্যতে এ ধরনের ঘটনার পুনরাবৃত্তি রোধে কার্যকর পদক্ষেপ নেওয়ার জন্য সংশ্লিষ্টদের প্রতি অনুরোধ জানাচ্ছে।

Advocate Md. Asaduzzaman, a former Secretary General and former Executive Committee Member of ASK, and one of its most active members, is a Senior Advocate of the Supreme Court of Bangladesh and a former Attorney General of Bangladesh. ASK warmly welcomes his assumption of this important responsibility.

We believe that his professional integrity, legal expertise, experience, and strong commitment to human values will further strengthen the country’s legal and judicial system.

We hope that, in carrying out his responsibilities at the Ministry of Law, Justice and Parliamentary Affairs, he will play an effective role in promoting human rights, justice, and the rule of law, and in facilitating greater access to justice for ordinary citizens.

মানবাধিকার কর্মী এডভোকেট মো. আসাদুজ্জামান কে আইনমন্ত্রী নিয়োগে আইন ও সালিশ কেন্দ্র ( আসক) এর অভিনন্দন

মানবাধিকার সংগঠন আইন ও সালিশ কেন্দ্র (আসক) এর সাবেক সেক্রেটারী জেনারেল, নির্বাহী পরিষদের সাবেক সদস্য এবং অন্যতম সক্রিয় সদস্য মানবাধিকার কর্মী, বাংলাদেশ সুপ্রীম কোর্টের সিনিয়র এডভোকেট এবং সাবেক এটর্নী জেনারেল মো. আসাদুজ্জামান নব নির্বাচিত সরকারের আইন, বিচার ও সংসদ বিষয়ক মন্ত্রী হিসেবে দায়িত্ব গ্রহণ করেছেন। তাঁর এই গুরুত্বপূর্ণ দায়িত্বে নিয়োগ পাওয়ায় আইন ও সালিশ কেন্দ্র (আসক) এর পক্ষ থেকে আন্তরিক অভিনন্দন ও শুভেচ্ছা।

এডভোকেট মো. আসাদুজ্জামান তিন দশকেরও বেশি সময় ধরে মানবাধিকার সুরক্ষা, আইনের শাসন প্রতিষ্ঠা এবং ন্যায়বিচার নিশ্চিত করার লক্ষ্যে কাজ করে আসছেন। তিনি নাগরিকের সাংবিধানিক অধিকার রক্ষায় উল্লেখযোগ্য সংখ্যক গুরুত্বপূর্ণ জনস্বার্থমূলক মামলা পরিচালনা করে মানবাধিকার প্রতিষ্ঠায় গুরুত্বপূর্ণ অবদান রেখেছেন। তার পেশাগত সততা, আইনি দক্ষতা, অভিজ্ঞতা এবং মানবিক মূল্যবোধ দেশের আইন ও বিচার ব্যবস্থাকে আরও শক্তিশালী করতে সহায়ক হবে বলে আমরা বিশ্বাস করি।

আমরা আশা করি, তিনি আইন, বিচার ও সংসদ বিষয়ক মন্ত্রণালয় এর দায়িত্ব পালনকালে মানবাধিকার, ন্যায়বিচার এবং আইনের শাসন প্রতিষ্ঠায় কার্যকর ভূমিকা রাখবেন এবং সাধারণ মানুষের ন্যায়বিচার প্রাপ্তি আরও সহজতর হবে।

মানবাধিকার, গণতন্ত্র এবং সাংবিধানিক মূল্যবোধ সমুন্নত রাখতে তার নেতৃত্ব বাংলাদেশ এর জন্য ইতিবাচক অবদান রাখবে বলে আইন ও সালিশ কেন্দ্র (আসক) আশাবাদ ব্যক্ত করছে।

According to information published in the media, one person was killed in election-related violence in Munshiganj district. Similarly, reports indicate that another person was killed in Bagerhat district. In addition, more than two hundred people have reportedly been injured in attacks in various areas of Sylhet, Cumilla, Narsingdi, Feni, Gazipur, Natore, Jhalokathi, Narail, Pabna, Bogura, Faridpur, Barguna, Jhenaidah, Chandpur, Patuakhali, Kishoreganj, Dinajpur and other districts. During the same period, allegations of rape against a woman have also emerged- an act that constitutes not only a grave criminal offence, but also a serious violation of human dignity and fundamental human rights.

ASK firmly believes that it is the constitutional obligation of the State to ensure the protection of the life, security and dignity of every citizen. Ensuring the safety and protection of women, minorities and socially vulnerable groups is a fundamental responsibility of both the State and political leadership.

In this context, ASK strongly urges all political parties to immediately issue clear and strict instructions at the grassroots level to prevent any form of retaliatory violence, attacks, forcible occupation, intimidation or violence against women. Political disagreement can never justify violence or violations of human rights.

At the same time, ASK calls upon law enforcement agencies and the relevant administrative authorities to ensure that every incident is brought under the justice process through prompt, impartial and credible investigations. In cases of sexual violence in particular, the State must take immediate measures to ensure the survivor’s safety, access to medical treatment, psychosocial support and legal assistance.

ASK emphasises that ensuring a peaceful and secure post-election environment is essential for the functioning of a democratic state system.

নির্বাচন-পরবর্তী সহিংসতা বন্ধে রাজনৈতিক দল ও রাষ্ট্রের প্রতি আইন ও সালিশ কেন্দ্র (আসক) এর আহ্বান

ত্রয়োদশ জাতীয় সংসদ নির্বাচন ও গণভোট পরবর্তী সময়ে বাংলাদেশ-এর বিভিন্ন স্থানে সংঘটিত সহিংসতা, প্রাণহানি এবং রাজনৈতিক প্রতিপক্ষের উপর হামলার ঘটনায় গভীর উদ্বেগ ও নিন্দা জানাচ্ছে আইন ও সালিশ কেন্দ্র (আসক)।

গণমাধ্যমে প্রকাশিত তথ্য অনুযায়ী, মুন্সীগঞ্জ জেলায় সহিংস ঘটনায় একজন নিহত হয়েছেন। একইভাবে বাগেরহাট জেলায়ও সহিংসতায় একজন নিহত হওয়ার তথ্য পাওয়া গেছে। পাশাপাশি সিলেট কুমিল্লা, নরসিংদী, ফেনী, গাজীপুর নাটোর, ঝালকাঠি, নড়াইল, পাবনা, বগুড়া, ফরিদপুর, বরগুনা, ঝিনাইদহ, চাঁদপুর, পটুয়াখালী, কিশোরগঞ্জ, দিনাজপুরসহ বেশ কয়েকটি জেলার বিভিন্ন স্থানে হামলার ঘটনায় দুই শতাধিক ব্যক্তি আহত হয়েছেন বলে জানা যাচ্ছে। একই সময়ে একজন নারী ধর্ষণের শিকার হয়েছেন বলে অভিযোগ উঠেছে, যা শুধু ফৌজদারি অপরাধ নয়, বরং মানব মর্যাদা ও মৌলিক অধিকার লঙ্ঘনের চরম উদাহরণ।

আইন ও সালিশ কেন্দ্র (আসক) দৃঢ়ভাবে বিশ্বাস করে, রাষ্ট্রের সাংবিধানিক দায়বদ্ধতা হচ্ছে প্রতিটি নাগরিকের জীবন, নিরাপত্তা এবং মর্যাদা রক্ষা করা। বিশেষ করে নারী, সংখ্যালঘু এবং সামাজিকভাবে ঝুঁকিপূর্ণ জনগোষ্ঠীর নিরাপত্তা নিশ্চিত করা রাষ্ট্র ও রাজনৈতিক নেতৃত্বের মৌলিক দায়িত্বের অংশ।

এই প্রেক্ষাপটে আসক সকল রাজনৈতিক দলের প্রতি জোরালোভাবে আহ্বান জানাচ্ছে, তারা যেন অবিলম্বে তৃণমূল পর্যায়ে কঠোর ও স্পষ্ট নির্দেশনা প্রদান করে, যাতে কোনো ধরনের প্রতিশোধমূলক সহিংসতা, হামলা, দখল, ভীতি প্রদর্শন বা নারী নির্যাতনের ঘটনা না ঘটে। রাজনৈতিক মতপার্থক্য কখনোই সহিংসতা বা মানবাধিকার লঙ্ঘনের বৈধতা দিতে পারে না।

একই সঙ্গে আইনশৃঙ্খলা রক্ষাকারী বাহিনী ও সংশ্লিষ্ট প্রশাসনের প্রতি আইন ও সালিশ কেন্দ্র (আসক) জোর দাবি জানাচ্ছে, প্রতিটি ঘটনা দ্রুত, নিরপেক্ষ ও বিশ্বাসযোগ্য তদন্তের মাধ্যমে বিচার প্রক্রিয়ার আওতায় আনতে হবে। বিশেষ করে যৌন সহিংসতার ক্ষেত্রে ভুক্তভোগীর নিরাপত্তা, চিকিৎসা, মানসিক সহায়তা এবং আইনি সহায়তা নিশ্চিত করতে রাষ্ট্রকে তাৎক্ষণিক পদক্ষেপ নিতে হবে।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, নির্বাচন-পরবর্তী শান্তিপূর্ণ ও নিরাপদ পরিবেশ নিশ্চিত করা গণতান্ত্রিক রাষ্ট্র ব্যবস্থার জন্য অপরিহার্য।

According to information published in the media, allegations have emerged regarding the death of Russel Kazi (29), who was detained during a joint forces operation in Kalkini Upazila of Madaripur district on 8 February 2026. Family members and local residents allege that he was detained by the joint forces in the morning of 7 February 2026 and that he died as a result of torture inflicted during the operation.

Meanwhile, another serious allegation surfaced on 9 February 2026 in Pallabi area of Dhaka. Imtiaz Hossain Rocky, brother of Ishtiaq Hossain Jony, who died in police custody at Pallabi Police Station in 2014 and the complainant in Jony’s murder case, along with his family members, alleged that at approximately 3:10 am on 9 February 2026, army personnel entered his residence without a warrant, detained him, conducted a search of the premises and subsequently took him to an army camp.

According to the information received, at the Mirpur Darus Salam Army Camp, Rocky was photographed while being made to stand beside an illegal firearm and was threatened with severe consequences should he protest or take any action regarding the incident. It is further alleged that he was forced to sign a document without being given the opportunity to read it or have its contents read out to him. Subjecting a citizen, against whom no criminal case is pending and who is himself a complainant in a custodial death case- to such harassment, fabricating allegations, attempting to frame him by planting a weapon and exerting psychological pressure constitute serious violations of human rights. It is noteworthy that the Jony murder case is a landmark case in Bangladesh’s history, setting a precedent for accountability in custodial death cases involving law enforcement agencies and is currently pending before the High Court.

ASK believes that the above-mentioned incidents constitute clear violations of the fundamental rights guaranteed under Articles 31, 32 and 35 of the Constitution of Bangladesh, the Torture and Custodial Death (Prevention) Act, 2013, the Penal Code, as well as the United Nations Convention against Torture.

In light of these incidents, ASK calls for the formation of independent and impartial investigation committees and urges the authorities to take immediate steps to ensure the safety and security of the victims and their families.

গণমাধ্যমে প্রকাশিত তথ্য অনুযায়ী, ৮ ফেব্রুয়ারী ২০২৬ তারিখে মাদারীপুর জেলার কালকিনি উপজেলায় যৌথ বাহিনীর অভিযানে আটক যুবক রাসেল কাজী (২৯)-এর মৃত্যুর অভিযোগ উঠেছে। পরিবার ও স্থানীয়দের অভিযোগ অনুযায়ী, ৭ ফেব্রুয়ারী ২০২৬ তারিখে সকালে যৌথ বাহিনী আটক করে। অভিযানের সময় তাকে নির্যাতনের ফলে তার মৃত্যু হয়েছে বলে দাবি করা হয়েছে।

অন্যদিকে, ৯ ফেব্রুয়ারি ২০২৬ তারিখে ঢাকার পল্লবী এলাকায় আরও একটি গুরুতর অভিযোগ সামনে এসেছে। ইমতিয়াজ হোসেন রকি, যিনি ২০১৪ সালে পল্লবী থানার পুলিশ হেফাজতে নিহত ইশতিয়াক হোসেন জনির ভাই এবং জনির হত্যা মামলার বাদী। তিনি ও তাঁর পরিবার অভিযোগ করেছেন যে, ৯ ফেব্রুয়ারী ২০২৬ রাত ৩টা ১০ মিনিটে সেনা সদস্যরা তার বাসায় প্রবেশ করে কোন ওয়ারেন্ট ছাড়াই তাকে আটক করে, ঘর তল্লাশি চালায় এবং পরবর্তীতে তাকে সেনা ক্যাম্পে নিয়ে যায়।

প্রাপ্ত তথ্য অনুযায়ী, মিরপুর দারুস সালাম সেনা ক্যাম্পে রকিকে একটি অবৈধ অস্ত্রের পাশে দাঁড় করিয়ে ছবি তোলা হয় এবং তাকে ভয়ভীতি প্রদর্শন করে বলা হয় যে বিষয়টি নিয়ে প্রতিবাদ বা কোন পদক্ষেপ গ্রহন করলে তার পরিণতি খারাপ হবে। আরও অভিযোগ রয়েছে যে, রকিকে একটি কাগজে স্বাক্ষর করতে বাধ্য করা হয়, যা তাকে পড়ার সুযোগ দেওয়া হয়নি বা পড়ে শোনানো হয়নি। একজন নাগরিক, যার বিরুদ্ধে কোনো ফৌজদারি মামলা নেই এবং যিনি নিজেই একটি হেফাজতে মৃত্যুর মামলার ভুক্তভোগী,তাকে এভাবে হয়রানি করা, মিথ্যা ঘটনা সাজিয়ে অস্ত্র দিয়ে ফাঁসানোর চেষ্টা করা এবং মানসিক চাপ প্রয়োগ করা গুরুতর মানবাধিকার লঙ্ঘনের শামিল। উল্লেখ্য, জনি হত্যা মামলা বাংলাদেশের ইতিহাসে আইনশৃঙ্খলা বাহিনীর হেফাজতে মৃত্যুর ঘটনায় দায়ীদের শাস্তির নজির স্থাপনকারী একটি গুরুত্বপূর্ণ মামলা এবং বর্তমানে যা উচ্চ আদালতে বিচারাধীন।

আইন ও সালিশ কেন্দ্র(আসক) মনে করে, উল্লিখিত ঘটনা দু’টি বাংলাদেশের সংবিধানের অনুচ্ছেদ ৩১, ৩২ ও ৩৫ এ নিশ্চিত মৌলিক অধিকার, হেফাজতে নির্যাতন ও মৃত্যু (নিবারণ) আইন, ২০১৩, দণ্ডবিধি এবং জাতিসংঘের নির্যাতনবিরোধী কনভেনশন এর সুস্পষ্ট লঙ্ঘন।

আইন ও সালিশ কেন্দ্র (আসক) এই ঘটনা দু’টির প্রেক্ষিতে স্বাধীন ও নিরপেক্ষ তদন্ত কমিটি গঠনের দাবি জানাচ্ছে। পাশাপাশি ভুক্তভোগী ও তাদের পরিবারের নিরাপত্তা নিশ্চিত করতে প্রয়োজনীয় পদক্ষেপ গ্রহনের আহবান জানাচ্ছে।

According to media reports, individuals and activists affiliated with different political ideologies are becoming victims of election-related violence. Most recently, a local leader of Jamaat was reportedly killed in Jhenaigati Upazila of Sherpur district, while a leader of the BNP was critically injured in the same incident. In addition, at least 30 supporters from both sides were injured in the clashes. Over the past several days, reports have also emerged of activists and supporters of various political parties being attacked in different parts of the country.

During the election campaign, allegations have surfaced of women being forcibly made to remove their burqa or niqab—an incident that is deeply disturbing and unacceptable. No citizen should be subjected to humiliation, coercion or pressure for participating in electoral activities. At the same time, the use of religion in election campaigns, or seeking votes by exerting direct or indirect pressure on citizens of other faiths, is also a matter of serious concern. Such practices are inconsistent with the constitutional guarantees of equal dignity, freedom of religion and freedom of expression.

Furthermore, media sources have reported allegations of attempts to influence voters through the provision of financial inducements, intimidation during campaigning, the use of indecent and offensive language, and defamatory remarks against rival candidates.

ASK emphasises that elections are a fundamental democratic process, and it is the constitutional responsibility of the State to ensure that every citizen can exercise their right to vote freely and without fear. Political parties, candidates, the election administration and law enforcement agencies share a collective responsibility to ensure an environment free from violence, irregularities, discrimination and intimidation.

ASK clearly states that any form of violence, incitement, attempts to influence voters through monetary inducements, misuse of religion, and conduct that violates basic standards of civility in the context of elections is wholly unacceptable. In the interest of organising a credible, trustworthy and inclusive election, ASK urges the authorities to take immediate, impartial and effective action against such incidents. ASK also calls upon all concerned to conduct election-related activities with mutual respect, restraint and full regard for human rights.

আসন্ন জাতীয় সংসদ নির্বাচনকে কেন্দ্র করে দেশের বিভিন্ন স্থানে রাজনৈতিক দল ও প্রার্থীদের মধ্যে সংঘর্ষ, সহিংসতা, উস্কানিমূলক বক্তব্য এবং উত্থাপিত অনিয়মের অভিযোগের ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) গভীর উদ্বেগ ও উৎকণ্ঠা প্রকাশ করছে। এসকল ঘটনা নির্বাচনকালীন পরিবেশকে প্রশ্নবিদ্ধ করছে এবং সাধারণ মানুষের মধ্যে ভয় ও নিরাপত্তাহীনতা তৈরি করছে, যা একটি অবাধ, সুষ্ঠু ও নিরপেক্ষ নির্বাচনের পরিপন্থী।

গণমাধ্যমে প্রকাশিত সংবাদ অনুযায়ী, নির্বাচনকে কেন্দ্র করে বিভিন্ন রাজনৈতিক মতাদর্শের ব্যক্তি ও কর্মীরা সহিংসতার শিকার হচ্ছেন। গতকাল শেরপুর জেলার ঝিনাইগাতি উপজেলায় জামায়াতের স্থানীয় একজন নেতা নিহত হওয়ার ঘটনা ঘটেছে, একই ঘটনায় বিএনপি দলীয় একজন নেতা গুরুতর আহত হয়েছেন। এ ছাড়াও সংঘর্ষে উভয় পক্ষের ৩০ জন কর্মী সমর্থক আহত হন। বিগত কয়েকদিনে দেশের নানা স্থানে বিভিন্ন রাজনৈতিক দলের কর্মী সমর্থকেরা প্রতিপক্ষের হামলার শিকার হয়েছেন বলে সংবাদ প্রকাশিত হয়েছে।

প্রচারণাকালে নারীদের বোরকা বা নেকাব জোরপূর্বক খুলে ফেলার একটি অভিযোগ উঠেছে, যা অত্যন্ত অনাকাঙ্ক্ষিত। নির্বাচনী কার্যক্রমে অংশগ্রহণের কারণে কোনো নাগরিককে এ ধরনের অপমান বা চাপের মুখে পড়তে যাওয়া কোনোভাবেই গ্রহণযোগ্য নয়। একই সঙ্গে প্রচারণায় ধর্মকে ব্যবহার করা কিংবা অন্যান্য ধর্মচর্চাকারী নাগরিকদের ওপর প্রত্যক্ষ বা পরোক্ষ চাপ সৃষ্টি করে ভোট চাওয়ার প্রবণতাও উদ্বেগজনক। এসব আচরণ সংবিধানে নিশ্চিত নাগরিকের সমান মর্যাদা, ধর্মীয় স্বাধীনতা এবং মতপ্রকাশের অধিকারের পরিপন্থী।

এ ছাড়া ভোটারদের প্রভাবিত করতে আর্থিক সুবিধা দেওয়ার চেষ্টা, প্রচারণাকালে ভয়ভীতি প্রদর্শন, শিষ্টাচারবিরোধী ও অশালীন ভাষার ব্যবহার এবং প্রতিদ্বন্দ্বী প্রার্থীদের বিরুদ্ধে বিষোদ্‌গার করার অভিযোগ গনমাধ্যম সুত্রে পাওয়া যাচ্ছে।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, নির্বাচন একটি মৌলিক গণতান্ত্রিক প্রক্রিয়া, যেখানে প্রতিটি নাগরিকের ভয়মুক্ত পরিবেশে নিজ পছন্দ অনুযায়ী ভোট প্রদানের অধিকার নিশ্চিত করা রাষ্ট্রের সাংবিধানিক দায়িত্ব। রাজনৈতিক দল, প্রার্থী, নির্বাচন সংশ্লিষ্ট প্রশাসন ও আইনশৃঙ্খলা রক্ষাকারী বাহিনীর সম্মিলিত দায়িত্ব হলো এমন একটি পরিবেশ নিশ্চিত করা, যেখানে সহিংসতা, অনিয়ম, বৈষম্য ও ভয়ভীতি প্রদর্শনের কোনো স্থান থাকবে না।

আইন ও সালিশ কেন্দ্র (আসক) স্পষ্টভাবে বলতে চায়, নির্বাচনকে কেন্দ্র করে যে কোনো ধরনের সহিংসতা, উসকানি, ভোটারকে অর্থ দিয়ে প্রভাবিত করার চেষ্টা, ধর্মের অপব্যবহার এবং শিষ্টাচারবিরোধী আচরণ সম্পূর্ণরূপে অগ্রহণযোগ্য। একটি গ্রহণযোগ্য, বিশ্বাসযোগ্য ও অংশগ্রহণমূলক নির্বাচন আয়োজনের স্বার্থে এসব ঘটনার বিরুদ্ধে অবিলম্বে নিরপেক্ষ ও কার্যকর পদক্ষেপ গ্রহণ করা জরুরি। পাশাপাশি পারস্পরিক সম্মান, সংযম ও মানবাধিকারের প্রতি শ্রদ্ধা বজায় রেখে নির্বাচনী কার্যক্রম পরিচালনা করার জন্য সকলের প্রতি অনুরোধ জানাচ্ছে।

Article 27 of the Constitution of Bangladesh guarantees that all citizens are equal before the law and entitled to equal protection of the law; Article 31 ensures the right to protection of the law; and Article 35(5) explicitly prohibits subjecting any person to cruel, inhuman or degrading punishment or treatment.

As an undertrial detainee, Jewel Hasan Saddam is not excluded from these constitutional protections. Yet, despite the extreme humanitarian circumstances arising from the death of his wife and infant child, the denial of parole release and the refusal to allow him to participate in their funeral and burial effectively subjected him to inhuman and degrading treatment, amounting to a direct violation of Article 35(5) of the Constitution.

Furthermore, the Ministry of Home Affairs of the Government of Bangladesh issued a Parole Policy on 1 June 2016, which provides that all categories of prisoners and detainees, including VIPs- may be granted parole for a specified period in the event of the death of close relatives, such as parents, parents-in-law, spouse, children or siblings. While the granting of parole involves administrative discretion, such discretion cannot be exercised arbitrarily, capriciously, or without providing any justification. In this instance, the failure to apply the relevant provisions despite a formal application by the family appears to be inconsistent with the intent of the policy and contrary to principles of fair and lawful administrative process.

These rights are also protected under international law. Bangladesh, as a State Party to the International Covenant on Civil and Political Rights (ICCPR), is bound by Article 7, which prohibits cruel, inhuman or degrading treatment or punishment and Article 10(1), which requires that all persons deprived of liberty be treated with humanity and with respect for the inherent dignity of the human person. Allowing a grieving detainee to see the bodies of his deceased wife and infant child for only five minutes at the prison gate, while denying him the opportunity to attend their funeral and burial, is wholly incompatible with these provisions of the ICCPR.

ASK maintains that citizens have the right to know on what legal, regulatory or executive grounds parole release was denied despite a formal application by the family. The rule of law is not limited to the act of decision-making alone; it also requires transparency in reasoning and accountability for decisions taken. In this case, the silence of the prison authorities and the concerned administration raises serious concerns regarding administrative arbitrariness and discriminatory treatment.

The precedent set by this incident is inconsistent with the principles of a constitutionally recognised, democratic and human rights-respecting system of governance. Clear explanations and accountability from the relevant state authorities are therefore imperative. In addition, there remains scope for the Honourable High Court to take suo motu cognisance of the matter.

যশোর কেন্দ্রীয় কারাগারে আটক বাগেরহাট সদর উপজেলা ছাত্রলীগের সভাপতি জুয়েল হাসান সাদ্দামকে তাঁর মৃত স্ত্রী ও ৯ মাস বয়সী শিশুসন্তানের জানাজা ও দাফনে অংশগ্রহণের জন্য পরিবারের পক্ষ থেকে যথাযথ কর্তৃপক্ষ বরাবর আনুষ্ঠানিক আবেদন জানানো সত্ত্বেও প্যারোলে মুক্তি না দিয়ে কেবল কারাফটকে মরদেহ দেখানোর ঘটনাকে আইন ও সালিশ কেন্দ্র (আসক) সংবিধান এবং আন্তর্জাতিক মানবাধিকার আইনের সুস্পষ্ট লঙ্ঘন হিসেবে মনে করছে।

বাংলাদেশ সংবিধানের-অনুচ্ছেদ ২৭ অনুযায়ী সকল নাগরিক আইনের দৃষ্টিতে সমান এবং সমান আইনি সুরক্ষার অধিকারী; অনুচ্ছেদ ৩১ নাগরিককে আইনের আশ্রয় লাভের অধিকার প্রদান করে; ৩৫(৫) অনুযায়ী কোনো ব্যক্তিকে নিষ্ঠুর, অমানবিক বা অবমাননাকর দণ্ড বা আচরণের শিকার করা যাবে না।

একজন বিচারাধীন বন্দী হিসেবে জুয়েল হাসান সাদ্দাম এসব সাংবিধানিক সুরক্ষা থেকে বঞ্চিত নন। অথচ তাঁর স্ত্রী ও শিশুসন্তানের মৃত্যুজনিত চরম মানবিক পরিস্থিতিতে পরিবারের আবেদন থাকা সত্ত্বেও প্যারোলে মুক্তি না দেওয়া এবং জানাজা ও দাফনে অংশগ্রহণের সুযোগ অস্বীকার করা কার্যত তাঁকে অমানবিক ও অবমাননাকর আচরণের শিকার করেছে, যা সংবিধানের ৩৫(৫) অনুচ্ছেদের সরাসরি ব্যত্যয়।

এ ছাড়া প্যারোলে মুক্তি বিষয়ে বাংলাদেশ সরকারের স্বরাষ্ট্র মন্ত্রণালয় ২০১৬ সালের ০১ জুন একটি নীতিমালা প্রণয়ন করে। উক্ত নীতিমালায় বলা হয়েছে- ভিআইপি বা অন্যান্য সকল শ্রেণীর কয়েদি বা হাজতি বন্দীদের নিকটাত্মীয়ের যেমন বাবা-মা, শ্বশুর-শাশুড়ি, স্বামী-স্ত্রী, সন্তানসন্ততি এবং আপন ভাই-বোন মারা গেলে নির্দিষ্ট সময়ের জন্য প্যারোলে মুক্তি দেয়া যাবে। এই নীতিমালা প্রশাসনিক বিবেচনার বিষয় হলেও তা ইচ্ছামতো, নির্বিচারে বা কোনো যুক্তি প্রকাশ না করে প্রত্যাখ্যানযোগ্য নয়। এই ক্ষেত্রে পরিবার কর্তৃক আবেদন জানানো সত্ত্বেও উক্ত বিধান প্রয়োগ না করা আইনের উদ্দেশ্য ও ন্যায্য প্রশাসনিক প্রক্রিয়ার পরিপন্থী বলে প্রতীয়মান হচ্ছে।

আন্তর্জাতিক আইনেও এই বিষয়ক অধিকার সুরক্ষিত। বাংলাদেশ যে আন্তর্জাতিক নাগরিক ও রাজনৈতিক অধিকার সনদ (আইসিসিপিআর) এর রাষ্ট্রপক্ষ, তার অনুচ্ছেদ ৭–এ নিষ্ঠুর, অমানবিক বা অবমাননাকর আচরণ নিষিদ্ধ করা হয়েছে; অনুচ্ছেদ ১০(১) এ বলা হয়েছে, স্বাধীনতাবঞ্চিত সকল ব্যক্তির সঙ্গে মানবিকতা ও মর্যাদার সঙ্গে আচরণ করতে হবে। কারাফটকে পাঁচ মিনিটের জন্য মৃত স্ত্রী ও শিশুসন্তানের মুখ দেখিয়ে একজন শোকাহত বন্দীকে জানাজা ও দাফনে অংশগ্রহণ থেকে বঞ্চিত করা, আইসিসিপিআর এর উল্লিখিত ধারাসমূহের সঙ্গে সম্পূর্ণ অসামঞ্জস্যপূর্ণ।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, কোন আইন, বিধি বা নির্বাহী আদেশের ভিত্তিতে পরিবারের আবেদন থাকা সত্ত্বেও প্যারোলে মুক্তি দেওয়া হয়নি, তা জানার অধিকার দেশের নাগরিকদের রয়েছে। আইনের শাসন কেবল সিদ্ধান্ত গ্রহণেই সীমাবদ্ধ নয়; সিদ্ধান্তের কারণ প্রকাশ এবং সেই সিদ্ধান্তের জবাবদিহি নিশ্চিত করাও এর অবিচ্ছেদ্য অংশ। এ ক্ষেত্রে কারা কর্তৃপক্ষ ও সংশ্লিষ্ট প্রশাসনের নীরবতা, প্রশাসনিক স্বেচ্ছাচার ও বৈষম্যমূলক আচরণের গুরুতর প্রশ্নের সৃষ্টি করেছে। এই ঘটনার মাধ্যমে যে দৃষ্টান্ত স্থাপিত হয়েছে, তা একটি সংবিধানস্বীকৃত, গণতান্ত্রিক ও মানবাধিকারসম্মত রাষ্ট্রব্যবস্থার সঙ্গে সামঞ্জস্যপূর্ণ নয় এবং এ বিষয়ে রাষ্ট্রের সংশ্লিষ্ট কর্তৃপক্ষের স্পষ্ট ব্যাখ্যা ও জবাবদিহি অপরিহার্য। পাশাপাশি, মহামান্য উচ্চ আদালতের স্বপ্রণোদিত পদক্ষেপ গ্রহনেরও সুযোগ রয়েছে।
