Ain o Salish Kendra (ASK) expresses deep concern and strongly condemns the incident of flogging and the imposition of fines in the name of a salish (informal arbitration) that took place on 26 November 2025 in Ward No. 9 of Burirchar Union, Hatiya Upazila, Noakhali.

According to reports published in the media, following a dispute over the use of loudspeakers during a wedding ceremony, several influential individuals in the village publicly assaulted members of both the bride’s and groom’s families. Under the guise of a salish, each victim was subjected to 15 lashes. In addition, a fine of BDT 30,000 (thirty thousand) was imposed and when the groom’s family failed to pay the amount, their auto-rickshaw was seized. These actions are entirely illegal, unlawful and unacceptable.

ASK firmly states that no individual, local salish, or informal authority has the legal mandate to impose corporal punishment or monetary fines. Articles 31, 32 and 35(5) of the Constitution of Bangladesh guarantee the right to protection under the law, personal liberty and freedom from cruel, inhuman, or degrading punishment. Any form of physical abuse, forced fines, or coercive seizure of property constitutes a direct violation of constitutional protections and existing laws. It is noteworthy that the High Court of Bangladesh has, through multiple judgments, clearly declared that village salish or any non-judicial body has no authority to impose physical punishment or fines and that all such practices are illegal and unconstitutional.

ASK strongly urges the authorities to conduct an immediate, impartial and effective investigation into the incident and to take appropriate legal action against all those involved. At the same time, the State must ensure the safety of the affected families and provide remedies for the violence, humiliation and rights violations they have suffered. ASK calls upon the local administration to take strict and effective measures, in line with High Court directives, to prevent illegal salish, corporal punishment and forced fines, so that no individual or group dares to engage in such unlawful practices in the future.

নোয়াখালীর হাতিয়া উপজেলার বুড়িরচর ইউনিয়নের ৯ নম্বর ওয়ার্ডে গত ২৬ নভেম্বর ২০২৫ তারিখে সালিশের নামে বেত্রাঘাত ও জরিমানার ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) গভীর উদ্বেগ এবং নিন্দা জানাচ্ছে।

গণমাধ্যমে প্রকাশিত তথ্য অনুযায়ী, কনের বিয়ের অনুষ্ঠানে মাইক বাজানোকে কেন্দ্র করে গ্রামের প্রভাবশালী কিছু ব্যক্তি বর ও কনের পরিবারকে প্রকাশ্যে মারধর করেন এবং সালিশের নামে প্রত্যেককে ১৫টি করে বেত্রাঘাতের শাস্তি কার্যকর করেন। এর পাশাপাশি তাদের ওপর ৩০,০০০/-(ত্রিশ হাজার) টাকা জরিমানা আরোপ করা হয় এবং সেই টাকা দিতে না পারায় বরপক্ষের অটোরিকশা আটকে রাখা হয়, যা সম্পূর্ণভাবে বেআইনি ও অগ্রহণযোগ্য।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, এ ধরনের শাস্তি আরোপের ক্ষমতা কোনো ব্যক্তি বা স্থানীয় সালিশকার বা কোন কর্তৃপক্ষের নেই। বাংলাদেশ সংবিধানের ৩১, ৩২ ও ৩৫(৫) অনুচ্ছেদ নাগরিকের আইনের সুরক্ষা, ব্যক্তিগত স্বাধীনতা এবং নিষ্ঠুর, অমানবিক ও অবমাননাকর দণ্ড থেকে সুরক্ষার নিশ্চয়তা দেয়। এর বাইরে গিয়ে শারীরিক নির্যাতন, জোরপূর্বক জরিমানা বা সম্পদ আটকে রেখে চাপ সৃষ্টি করা সংবিধান ও প্রচলিত আইনের সরাসরি লঙ্ঘন। উল্লেখ্য, দেশের উচ্চ আদালত একাধিক রায়ে স্পষ্টভাবে ঘোষণা করেছেন যে, গ্রামীণ সালিশ বা স্থানীয়ভাবে গঠিত কোনো অ-বিচারিক কাঠামোর শারীরিক শাস্তি বা জরিমানা আরোপের ক্ষমতা নেই এবং এ ধরনের সব কার্যকলাপ অবৈধ ও অসাংবিধানিক।

আইন ও সালিশ কেন্দ্র (আসক) জোর দিয়ে বলছে যে, ঘটনার সঙ্গে সংশ্লিষ্ট ব্যক্তিদের বিরুদ্ধে অবিলম্বে নিরপেক্ষ তদন্ত ও আইনি ব্যবস্থা গ্রহণ করা অত্যন্ত জরুরি। পাশাপাশি ভুক্তভোগী পরিবারকে নিরাপত্তা প্রদান এবং তাদের প্রতি হওয়া অবমাননা ও সহিংসতার প্রতিকার প্রদান রাষ্ট্রের দায়িত্ব। স্থানীয় প্রশাসনের প্রতি আইন ও সালিশ কেন্দ্র (আসক)আহ্বান জানাচ্ছে, এ ধরনের বেআইনি সালিশ, শারীরিক শাস্তি ও জোরপূর্বক জরিমানা বন্ধে উচ্চ আদালতের নির্দেশনা অনুযায়ী আরও কঠোর ও কার্যকর ব্যবস্থা নিতে হবে, যাতে ভবিষ্যতে কোনো ব্যক্তি বা গোষ্ঠী এ ধরনের দুঃসাহস না পায়।
