Ain o Salish Kendra (ASK) strongly condemns the death of Shamsuzzaman Dablu, General Secretary of Jibannagar Municipal BNP in Chuadanga, while in army custody and demands an impartial investigation into the incident. ASK views this incident as a serious violation of human rights. The death of a person in state custody is not only a tragedy for a family, but also a direct assault on the Constitution, the rule of law and the state’s obligation to protect human rights.

According to media reports, the victim’s wife, Jesmin Nahar and family members have alleged that on 12 January at approximately 10:15 pm, members of the army detained Dablu from a pharmacy and took him to the BNP party office located about 50 meters away, where he was subjected to torture for nearly two hours. He was later taken to the hospital in critical condition, where doctors declared him dead. According to Dr. Mokbul Hossain, Upazila Health and Family Planning Officer of Jibannagar, Dablu was brought dead to the Jibannagar Health Complex at 12:16 am on 12 January.

Under Articles 31 and 32 of the Constitution of Bangladesh, ensuring the right to life and personal liberty of every citizen is a fundamental responsibility of the state. Furthermore, the Torture and Custodial Death (Prevention) Act, 2013 clearly prohibits torture and cruel, inhuman, or degrading treatment and provides for punishment of those responsible for torture or death in custody.

Bangladesh is also a State Party to the International Covenant on Civil and Political Rights (ICCPR) and the Convention against Torture (CAT), which obligate the state to ensure prompt, impartial and effective investigations and accountability in cases of torture or death in state custody.

ASK further emphasizes that no member of law enforcement or security forces is above the law. Failure to take immediate and effective measures to prevent abuse of state power and to ensure the safety of citizens’ lives increases the risk of such incidents recurring in the future.

ASK believes that a transparent, independent and impartial investigation into this incident is urgently necessary and calls upon the state to take immediate and responsible steps to ensure justice.

চুয়াডাঙ্গার জীবননগর পৌর বিএনপির সাধারণ সম্পাদক শামসুজ্জামান ডাবলু সেনা হেফাজতে থাকা অবস্থায় মৃত্যুবরণ করার ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) তীব্র নিন্দা ও নিরপেক্ষ তদন্তের দাবি জানাচ্ছে। আইন ও সালিশ কেন্দ্র (আসক) এই ঘটনাকে গুরুতর মানবাধিকার লঙ্ঘন হিসেবে দেখছে। রাষ্ট্রীয় হেফাজতে কোনো ব্যক্তির মৃত্যু শুধু একটি পরিবারের জন্য নয়, বরং সংবিধান, আইনের শাসন এবং মানবাধিকারের প্রতি রাষ্ট্রের দায়বদ্ধতার ওপর সরাসরি আঘাত।

গনমাধ্যম সুত্রে জানা যাচ্ছে, নিহতের স্ত্রী জেসমিন নাহার ও স্বজনরা অভিযোগ করেছেন ১২ জানুয়ারি রাত আনুমানিক ১০টা ১৫ মিনিটে সেনাবাহিনীর সদস্যরা একটি ফার্মেসি থেকে ডাবলুকে আটক করে প্রায় ৫০ মিটার দূরে বিএনপি দলীয় কার্যালয়ে নিয়ে যান এবং সেখানে প্রায় দুই ঘণ্টা ধরে নির্যাতন চালানো হয়। পরবর্তীতে গুরুতর অসুস্থ অবস্থায় তাঁকে হাসপাতালে নেওয়া হলে চিকিৎসক মৃত ঘোষণা করেন। জীবননগর উপজেলা স্বাস্থ্য ও পরিবার পরিকল্পনা কর্মকর্তা ডা. মকবুল হোসেনের তথ্যমতে, ১২ জানুয়ারি রাত ১২টা ১৬ মিনিটে ডাবলুকে জীবননগর স্বাস্থ্য কমপ্লেক্সে মৃত অবস্থায় আনা হয়।

বাংলাদেশের সংবিধানের ৩১ ও ৩২ অনুচ্ছেদ অনুযায়ী প্রত্যেক নাগরিকের জীবন ও ব্যক্তিস্বাধীনতার অধিকার নিশ্চিত করা রাষ্ট্রের মৌলিক দায়িত্ব। পাশাপাশি, নির্যাতন ও হেফাজতে মৃত্যু (নিবারণ) আইন, ২০১৩ স্পষ্টভাবে নির্যাতন, নিষ্ঠুর, অমানবিক ও অবমাননাকর আচরণ নিষিদ্ধ করেছে এবং হেফাজতে নির্যাতন বা মৃত্যুর মত ঘটনায় দায়ী ব্যক্তিদের বিরুদ্ধে শাস্তির বিধান রেখেছে।

এছাড়াও বাংলাদেশ আন্তর্জাতিকভাবে আন্তর্জাতিক নাগরিক ও রাজনৈতিক অধিকার সংক্রান্ত চুক্তি (ICCPR) এবং নির্যাতনবিরোধী কনভেনশন (CAT), এর রাষ্ট্রপক্ষ ; যেখানে রাষ্ট্রীয় হেফাজতে নির্যাতন ও মৃত্যুর ঘটনায় দ্রুত, নিরপেক্ষ ও কার্যকর তদন্ত এবং দায়ীদের জবাবদিহি নিশ্চিত করার বাধ্যবাধকতা রয়েছে।

একই সঙ্গে আইন ও সালিশ কেন্দ্র (আসক) জোর দিয়ে বলতে চায়, আইন প্রয়োগকারী বা নিরাপত্তা বাহিনীর কোনো সদস্যই আইনের ঊর্ধ্বে নয়। রাষ্ট্রীয় ক্ষমতার অপব্যবহার রোধ এবং নাগরিকের জীবনের নিরাপত্তা নিশ্চিত করতে অবিলম্বে কার্যকর পদক্ষেপ গ্রহণ করা না হলে এমন ঘটনা ভবিষ্যতে আরও ঘটার আশঙ্কা থেকে যায়।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, এই ঘটনার স্বচ্ছ, স্বাধীন ও নিরপেক্ষ তদন্ত করা জরুরি। পাশাপাশি, ন্যায়বিচার নিশ্চিত করতে রাষ্ট্রের প্রতি অবিলম্বে দায়িত্বশীল পদক্ষেপ গ্রহণের আহ্বান জানাচ্ছে।
