Ain o Salish Kendra (ASK) expresses its deep concern, strong condemnation and outrage over the organised attack on the home of Kazi Mizanur Rahman, an Awami League leader and former Union Parishad Chairman, in Madhabkhali Union under Mirzaganj Upazila of Patuakhali, during which the house was demolished with a bulldozer, looted and set on fire.

According to media reports, in the early hours of 17 July, a group of individuals attacked the residence of Kazi Mizanur Rahman. It has been alleged that the attackers first looted the house, then demolished various parts of it using a bulldozer and subsequently set it on fire. The victim’s family has alleged that several local leaders and activists of the Bangladesh Nationalist Party (BNP) were involved in the attack, although the accused persons have denied the allegations.

ASK believes that if there are allegations against any individual or group, they must be addressed only through legal and judicial processes. Demolishing a person’s home, looting property or committing arson without a court order or due legal process is entirely unlawful and contrary to the rule of law. Regardless of political identity or ideology, it is the constitutional responsibility of the State to protect the life, property and security of every citizen.

It is particularly concerning that such organised attacks involving demolition, looting and arson continue to occur even after an elected government has assumed office, as was witnessed during the tenure of the previous interim government. Such incidents raise serious questions about the rule of law, public security and the effectiveness of the State’s law enforcement system. Such acts are unacceptable under any circumstances. Allowing any individual or group to take the law into their own hands will further encourage a culture of impunity and create an atmosphere of fear and insecurity in society.

Articles 27 and 31 of the Constitution of Bangladesh guarantee every citizen the right to equal protection of the law. Similarly, Article 17 of the Universal Declaration of Human Rights recognises the right of every person to own property and provides that no one shall be arbitrarily deprived of their property. In addition, Article 12 guarantees protection against arbitrary interference with a person’s home and private life. In light of these constitutional guarantees and international human rights standards, such attacks are a matter of grave concern.

ASK calls upon the relevant authorities to ensure an immediate, impartial and effective investigation into the incident. It also urges the authorities to take the necessary measures to prevent the recurrence of such incidents in the future.

পটুয়াখালীতে আওয়ামী লীগ নেতার বাড়িতে বুলডোজার দিয়ে ভাঙচুর লুটপাট ও অগ্নিসংযোগের ঘটনায় আইন ও সালিশ কেন্দ্র (আসক)-এর গভীর উদ্বেগ ও তীব্র নিন্দা

পটুয়াখালীর মির্জাগঞ্জ উপজেলার মাধবখালী ইউনিয়নে আওয়ামী লীগ নেতা ও সাবেক ইউনিয়ন পরিষদ চেয়ারম্যান কাজী মিজানুর রহমানের বসতবাড়িতে সংঘবদ্ধ হামলা চালিয়ে বুলডোজার দিয়ে গুঁড়িয়ে দেওয়া, লুটপাট এবং অগ্নিসংযোগের ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) গভীর উদ্বেগ, তীব্র নিন্দা ও ক্ষোভ প্রকাশ করছে।

গণমাধ্যমে প্রকাশিত সংবাদ অনুযায়ী, গত ১৭ জুলাই দিবাগত গভীর রাতে একদল ব্যক্তি কাজী মিজানুর রহমানের বসতবাড়িতে হামলা চালায়। অভিযোগ রয়েছে, হামলাকারীরা প্রথমে বাড়ীতে লুটপাট করে  এরপর বুলডোজার দিয়ে বাড়ির বিভিন্ন অংশ ভেঙে ফেলে এবং পরবর্তীতে বাড়িটিতে অগ্নিসংযোগ করে। ভুক্তভোগী পরিবারের দাবি, হামলায় স্থানীয় বিএনপির কয়েকজন নেতাকর্মী জড়িত ছিলেন। যদিও অভিযুক্ত ব্যক্তিরা অভিযোগ অস্বীকার করেছেন।

আইন ও সালিশ কেন্দ্র (আসক)  মনে করে, কোনো ব্যক্তি বা গোষ্ঠীর বিরুদ্ধে অভিযোগ থাকলে তার প্রতিকার কেবল আইন ও বিচারিক প্রক্রিয়ার মাধ্যমেই হতে পারে। আদালতের আদেশ বা যথাযথ আইনি প্রক্রিয়া ছাড়া কারও বাড়িঘর ভেঙে ফেলা, সম্পদ লুট করা কিংবা অগ্নিসংযোগ করা সম্পূর্ণ বেআইনি এবং আইনের শাসনের পরিপন্থী। রাজনৈতিক পরিচয় বা মতাদর্শ যাই হোক না কেন, প্রত্যেক নাগরিকের জীবন, সম্পদ ও নিরাপত্তা রক্ষা করা রাষ্ট্রের সাংবিধানিক দায়িত্ব।

বিশেষভাবে উদ্বেগের বিষয় হলো, একটি নির্বাচিত সরকারের দায়িত্ব গ্রহণের পরও যদি বিগত অন্তর্বর্তী কালীন সরকারের আমলের মত সংঘবদ্ধভাবে এ ধরনের হামলা, ভাঙচুর, লুটপাট ও অগ্নিসংযোগের ঘটনা ঘটে, তবে তা আইনের শাসন, জননিরাপত্তা এবং রাষ্ট্রের আইন প্রয়োগ ব্যবস্থার কার্যকারিতা সম্পর্কে গুরুতর প্রশ্নের জন্ম দেয়। এ ধরনের ঘটনা কোনোভাবেই গ্রহণযোগ্য হতে পারে না। কোনো ব্যক্তি বা গোষ্ঠীকে আইন নিজের হাতে তুলে নেওয়ার সুযোগ দেওয়া হলে তা বিচারহীনতার সংস্কৃতিকে আরও উৎসাহিত করবে এবং সমাজে ভয় ও অনিরাপত্তার পরিবেশ সৃষ্টি করবে।

বাংলাদেশের সংবিধানের ২৭ ও ৩১ অনুচ্ছেদে সকল নাগরিকের আইনের সমান সুরক্ষা পাওয়ার অধিকার নিশ্চিত করা হয়েছে। একইভাবে, সর্বজনীন মানবাধিকার ঘোষণার ১৭ অনুচ্ছেদে প্রত্যেক ব্যক্তির সম্পত্তির অধিকার স্বীকৃত হয়েছে এবং কাউকে খেয়ালখুশিমতো তার সম্পত্তি থেকে বঞ্চিত না করার কথা বলা হয়েছে। এছাড়া ১২ অনুচ্ছেদে ব্যক্তির গৃহ ও ব্যক্তিগত জীবনে বেআইনি হস্তক্ষেপ থেকে সুরক্ষার নিশ্চয়তা প্রদান করা হয়েছে। এসব সাংবিধানিক ও আন্তর্জাতিক মানবাধিকার মানদণ্ডের আলোকে এ ধরনের হামলা রাষ্ট্রের জন্য গভীর উদ্বেগের বিষয়।

আইন ও সালিশ কেন্দ্র (আসক) অবিলম্বে এই ঘটনার নিরপেক্ষ  ও কার্যকর তদন্ত নিশ্চিত করার জন্য সংশ্লিষ্ট কর্তৃপক্ষের প্রতি আহ্বান জানাচ্ছে। একই সঙ্গে ভবিষ্যতে এ ধরনের ঘটনার পুনরাবৃত্তি রোধে প্রয়োজনীয় পদক্ষেপ গ্রহণের জন্য সংশ্লিষ্ট কর্তৃপক্ষের প্রতি অনুরোধ জানাচ্ছে।
