Subject Matter: Forced forestation by the Department of Forest in Antarpur village under the Police Station- Dharmopasha, District- Sunamgong, violating the lease agreement given by the Deputy Commissioner, Sunamganj to the 570 Garo and Bangali families who had possessed the lands by generations. ASK along with the members of the affected communities challenged the legality of the forestation.
Court’s Response: The Court issued a rule nisi on June 17, 2007 calling upon the respondents to show cause as to why the impugned forced forestation by the respondents in the said land should not be declared to be without lawful authority and is of no legal effect and also directed the respondents to maintain status quo on the scheduled land mentioned in the writ petition till disposal of the case.
Current Status: The case is now pending. The Garo and Bangali families (570 in total) are in peaceful possession of the lands.
