Ain o Salish Kendra (ASK) expresses deep concern over the deaths of two citizens, Mukhtar Hossain and Shahadat Hossain, while in the custody of the Detective Branch (DB) police in Dhaka and Sirajganj districts, as reported in various media outlets.

ASK underscores that ensuring the safety of individuals in state custody is a constitutional duty and a legal responsibility of law enforcement agencies. Such deaths raise urgent questions regarding the State’s compliance with national human rights commitments, constitutional guarantees and international standards.

The organization emphasizes that any death in state custody is a serious violation of Article 32 of the Constitution, which guarantees the right to life and personal liberty and contravenes fundamental principles of international human rights law, which clearly obligate the State to ensure the security of persons in detention.

According to ASK’s records, from January to 22 November 2025, at least 15 citizens have died while in the custody of various police stations, the Rapid Action Battalion (RAB), the Police Bureau of Investigation (PBI) and the DB across the country. This figure reflects not just statistics but a worrying pattern of institutional negligence, lack of accountability and systemic weaknesses.

ASK demands that each case of custodial death be subject to an independent, impartial and judicial investigation. Those responsible must be held accountable through proper legal processes and the rights of victims’ families, including security, access to justice, and legal support- must be ensured without delay.

Ain o Salish Kendra (ASK) reiterates that safeguarding life in custody is a non-negotiable obligation of the State and failure to do so undermines both the rule of law and human rights protection.

গণমাধ্যমে প্রকাশিত সংবাদ সুত্রে জানা যাচ্ছে, ঢাকা ও সিরাজগঞ্জ জেলায় ডিবি পুলিশের হেফাজতে মুক্তার হোসেন ও শাহাদত হোসেন নামের দুই নাগরিকের মৃত্যু ঘটেছে। এই ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) গভীর উদ্বেগ প্রকাশ করছে।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, রাষ্ট্রীয় হেফাজতে থাকা ব্যক্তিদের নিরাপত্তা নিশ্চিত করা আইন-শৃঙ্খলা রক্ষাকারী বাহিনীর দায়িত্ব ও সাংবিধানিক কর্তব্য। এ ধরনের মৃত্যু আমাদের জাতীয় মানবাধিকার অঙ্গীকার, সংবিধান এবং আন্তর্জাতিক মানদণ্ডের সাথে সামঞ্জস্য রক্ষার প্রয়াসে নতুন করে আলোচনা ও মূল্যায়নের প্রয়োজনীয়তা তুলে ধরে।

আইন ও সালিশ কেন্দ্র (আসক) আরো মনে করে, রাষ্ট্রের হেফাজতে থাকা কোনো ব্যক্তির মৃত্যু অত্যন্ত গুরুতর বিষয় এবং এটি সংবিধানের ৩২ অনুচ্ছেদে বর্ণিত জীবন ও ব্যক্তিস্বাধীনতার অধিকারকে লঙ্ঘন করে। একইসাথে এটি আন্তর্জাতিক মানবাধিকার সনদের মৌলিক নীতির পরিপন্থী, যেখানে হেফাজতে থাকা ব্যক্তির নিরাপত্তা নিশ্চিত করা রাষ্ট্রের আইনগত ও নৈতিক বাধ্যবাধকতা হিসেবে স্পষ্টভাবে উল্লেখ রয়েছে।

আইন ও সালিশ কেন্দ্র (আসক) এর তথ্য সংরক্ষণ হিসাবে ২০২৫ সালের জানুয়ারি থেকে ২২ নভেম্বর পর্যন্ত শুধুমাত্র দেশের বিভিন্ন থানা হেফাজতসহ, র‍্যাব, পিবিআই ও ডিটেকটিভ ব্রাঞ্চ (ডিবি ) এর হেফাজতে রাখা অবস্থায় সারাদেশে কমপক্ষে ১৫ জন নাগরিকের মৃত্যু ঘটেছে। এই সংখ্যাটি কেবল পরিসংখ্যান নয় এটি দায়িত্বহীনতা, জবাবদিহিতার অভাব ও প্রাতিষ্ঠানিক দুর্বলতার সংকটকে আরও স্পষ্ট করে তুলে ধরে।

হেফাজতে মৃত্যুর প্রতিটি ঘটনা স্বাধীন, নিরপেক্ষ এবং বিচার বিভাগীয় তদন্তের আওতায় আনার দাবি জানাচ্ছে আইন ও সালিশ কেন্দ্র (আসক)। সংশ্লিষ্ট ঘটনাগুলোতে দায়ী ব্যক্তিদের দায় নিরূপণ করে আইনগত জবাবদিহি নিশ্চিত করা রাষ্ট্রের দায়িত্ব, যা কোনোভাবেই উপেক্ষিত থাকতে পারে না। পাশাপাশি, ভুক্তভোগী পরিবারের নিরাপত্তা, ন্যায়বিচারের অধিকার এবং আইনগত সহায়তা নিশ্চিত করাও অত্যাবশ্যক।
