Ain o Salish Kendra (ASK) expresses deep concern and strongly condemns the incident in Manikganj where a group identifying themselves as “Tawhidi Jonota” attacked, assaulted and intimidated participants of a peaceful human chain organised by followers and admirers of a Baul artist, protesting his arrest. Attacks on peaceful assemblies and the right to express dissent are wholly unacceptable and constitute a clear violation of constitutionally guaranteed civil rights.

Articles 37 and 39 of the Constitution of Bangladesh explicitly guarantee the rights to freedom of expression, peaceful assembly and cultural practice. The protection and promotion of all cultural and spiritual traditions of the country, including the Baul heritage, are constitutional obligations of the State. Any attempt to obstruct or attack artistic and cultural expression under the pretext of ideological differences or social pressure runs contrary to the law and fundamental human rights.

ASK observes with grave concern that in recent times there have been multiple incidents involving threats and attacks against Baul artists and cultural activists. The failure to take effective and timely legal action in such cases has emboldened groups hostile to art and culture, leading to the recurrence of similar attacks. This emerging pattern poses a serious threat to the rule of law, the protection of human rights and cultural freedom in the country.

ASK firmly believes that those responsible for the attack on the peaceful human chain must be identified through a prompt, impartial and effective investigation and brought to justice. At the same time, the arrested Baul artist must be ensured due process of law, access to justice and the protection of his right to freedom of expression. Ensuring the safety and security of artists and cultural practitioners is a fundamental responsibility of the State. Any failure in this regard risks further conflict, violence and the deepening of social intolerance.

In defence of human rights, cultural freedom and the rule of law, Ain o Salish Kendra (ASK) reiterates its principled position and strongly condemns any attack or repressive action against peaceful expression or cultural practice.

মানিকগঞ্জে বাউল শিল্পীকে গ্রেফতার ও প্রতিবাদ মানববন্ধনে হামলার ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) এর গভীর উদ্বেগ ও নিন্দা

মানিকগঞ্জে বাউল শিল্পীকে গ্রেফতারের ঘটনাকে কেন্দ্র করে তার ভক্ত ও অনুরাগীদের আয়োজিত শান্তিপূর্ণ মানববন্ধনে “তৌহিদি জনতা” পরিচয়ে একদল লোকের হামলা, মারধর ও ভয়ভীতি প্রদর্শনের ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) গভীর উদ্বেগ ও নিন্দা জানাচ্ছে। শান্তিপূর্ণ মতপ্রকাশের অধিকার ও গণজমায়েতে হামলা করা কোনোভাবেই গ্রহণযোগ্য নয়; বরং এটি সংবিধান স্বীকৃত নাগরিক অধিকার লঙ্ঘনের সুস্পষ্ট উদাহরণ।

বাংলাদেশ সংবিধানের ৩৭ ও ৩৯ অনুচ্ছেদে মতপ্রকাশের স্বাধীনতা, শান্তিপূর্ণ সমাবেশের অধিকার এবং সংস্কৃতি চর্চার স্বাধীনতা সুস্পষ্টভাবে নিশ্চিত করা হয়েছে। বাউল ঐতিহ্যসহ দেশের সকল সাংস্কৃতিক ও আধ্যাত্মিক ধারা রক্ষা করা রাষ্ট্রের সাংবিধানিক দায়িত্ব। কোনো গোষ্ঠীর মতাদর্শিক অবস্থান বা সামাজিক চাপের অজুহাতে শিল্প-সংস্কৃতির ওপর হামলা বা বাধা দেওয়ার প্রচেষ্টা আইন ও মানবাধিকারের পরিপন্থী।

আইন ও সালিশ কেন্দ্র (আসক) লক্ষ করছে যে, সম্প্রতি সময়ে বাউল শিল্পী ও সংস্কৃতি কর্মীদের উপর হুমকি ও হামলার একাধিক ঘটনা ঘটেছে। এসব ঘটনায় কার্যকর ও সময়োপযোগী আইনগত ব্যবস্থা গ্রহণ না করায় দেশে শিল্প সংস্কৃতি বিরোধী গোষ্ঠী আরও উৎসাহিত হয়ে উঠছে এবংএকই সঙ্গে হামলার ঘটনাগুলোর পুনরাবৃত্তি ঘটছে। চলমান এই প্রবণতা আইনের শাসন, মানবাধিকার সুরক্ষা ও সাংস্কৃতিক স্বাধীনতার জন্য গভীর হুমকি বলে প্রতীয়মান হচ্ছে।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, মানববন্ধনে হামলার ঘটনার সঙ্গে জড়িতদের বিরুদ্ধে দ্রুত ও নিরপেক্ষ তদন্ত এবং আইনি ব্যবস্থা গ্রহণ করা অপরিহার্য। একই সঙ্গে গ্রেফতার হওয়া বাউল শিল্পীর ক্ষেত্রে আইনানুগ প্রক্রিয়া, ন্যায়বিচার এবং স্বাধীন মতপ্রকাশের অধিকার নিশ্চিত করতে হবে। শিল্পী, সংস্কৃতি কর্মীদের নিরাপত্তা নিশ্চিত করা রাষ্ট্রের দায়িত্ব, যা এড়িয়ে যাওয়ার চেষ্টা করা হলে আরও সংঘাত, সহিংসতা এবং সামাজিক অসহিষ্ণুতা বৃদ্ধি পেতে পারে।

মানবাধিকার, সাংস্কৃতিক স্বাধীনতা এবং আইনের শাসন রক্ষায় আইন ও সালিশ কেন্দ্র (আসক) তার অবস্থান পুনর্ব্যক্ত করছে এবং শান্তিপূর্ণ মতপ্রকাশ বা সাংস্কৃতিক চর্চার ওপর যেকোনো হামলা বা দমনমূলক আচরণের বিরুদ্ধে তীব্র নিন্দা জানাচ্ছে।
