Ensuring Free Media is an Essential Condition for Democracy and Human Rights: Ain o Salish Kendra (ASK)

On the occasion of World Press Freedom Day, observed on 3 May, the human rights organisation Ain o Salish Kendra (ASK) reaffirms the fundamental importance of a free, independent and responsible media. Without such a media environment, it is not possible to ensure democratic development, the protection of human rights and meaningful state accountability. Freedom of expression is not merely a standalone right; it is one of the foundations upon which the protection of all other rights depends. An independent media strengthens the voice of citizens, exposes abuses of power and contributes to the pursuit of justice.

Article 39 of the Constitution of Bangladesh guarantees freedom of thought, conscience, speech and the press, placing an obligation on the State to create an environment in which journalists and citizens can express their views without fear of intimidation or harassment. Likewise, Article 19 of the Universal Declaration of Human Rights and Article 19 of the International Covenant on Civil and Political Rights (ICCPR) recognise the freedom to seek, receive and impart information as a fundamental right. As a party to these international commitments, Bangladesh bears the responsibility to protect freedom of expression, ensure the safety of journalists and refrain from imposing unreasonable restrictions.

ASK believes that media freedom in Bangladesh continues to face multidimensional challenges. The threat of legal action and arrest against journalists, harassment of citizens for expressing opinions in digital spaces, strategic pressure on investigative journalism, ownership influence, self-censorship and obstacles to news gathering in the field are all realities that restrict the space for independent journalism. Allegations of attacks, threats and surveillance against journalists also continue to emerge, which is a matter of serious concern.

At the same time, limitations in the effective implementation of the Right to Information Act, reluctance to provide access to official information and the tendency to withhold information of public interest undermine democratic transparency. When the media faces barriers in accessing information, the public is equally deprived of its right to know the truth.

The challenges posed by misinformation, disinformation, incitement to violence and hate speech are also part of today’s reality. However, the appropriate response to these challenges is not to restrict freedom of expression. Rather, efforts should focus on strengthening fact-checking mechanisms, improving professional standards in journalism, enhancing digital literacy and developing accountable regulatory frameworks.

On World Press Freedom Day, ASK expresses the following expectations:

  1. Effective protection measures must be adopted to ensure the safety and security of journalists and media professionals.
  2. Laws, policies and practices that undermine freedom of expression should be reviewed and reformed.
  3. Attacks, violence and harassment against journalists must be investigated impartially and those responsible held accountable.
  4. The Right to Information Act should be effectively implemented and access to public information made easier.
  5. The State, media institutions and civil society should work together to foster an environment that supports independent, diverse and ethical journalism.
  6. Safe and non-discriminatory working environments must be ensured for women journalists and media professionals from marginalised communities.

Marking World Press Freedom Day, ASK Executive Director Tahmina Rahman called upon the relevant authorities to take action, stating: Ensuring a free, independent and safe media environment is a fundamental responsibility of a democratic State. Effective measures are urgently needed to ensure that journalists can carry out their professional duties without fear, pressure or harassment. When press freedom is protected, the rights of citizens are better protected as well.

৩ মে বিশ্ব মুক্ত গণমাধ্যম দিবস উপলক্ষে মানবাধিকার সংগঠন আইন ও সালিশ কেন্দ্র (আসক) গভীর গুরুত্বের সঙ্গে পুনর্ব্যক্ত করছে যে, মুক্ত, স্বাধীন ও দায়িত্বশীল গণমাধ্যম ছাড়া গণতন্ত্রের বিকাশ, মানবাধিকারের সুরক্ষা এবং রাষ্ট্রীয় জবাবদিহি নিশ্চিত করা সম্ভব নয়। মতপ্রকাশের স্বাধীনতা কেবল একটি স্বতন্ত্র অধিকার নয়; এটি অন্যান্য অধিকারের সুরক্ষা নিশ্চিত করার অন্যতম ভিত্তি। স্বাধীন গণমাধ্যম নাগরিকের কণ্ঠকে শক্তিশালী করে, ক্ষমতার অপব্যবহার উন্মোচিত করে এবং ন্যায়বিচার প্রতিষ্ঠার পথ সুগম করে।

বাংলাদেশের সংবিধানের ৩৯ অনুচ্ছেদে চিন্তা, বিবেক,বাকস্বাধীনতা ও সংবাদপত্রের স্বাধীনতার স্বীকৃতি দেওয়া হয়েছে, যা রাষ্ট্রের ওপর এমন পরিবেশ নিশ্চিত করার দায়িত্ব আরোপ করে-যেখানে সাংবাদিক ও নাগরিকেরা ভয় বা হয়রানির আশঙ্কা ছাড়াই মত প্রকাশ করতে পারেন। একই সঙ্গে, সর্বজনীন মানবাধিকার ঘোষণাপত্রের ১৯ অনুচ্ছেদ এবং আন্তর্জাতিক নাগরিক ও রাজনৈতিক অধিকার সম্পর্কিত চুক্তির (আইসিসিপিআর) ১৯ অনুচ্ছেদে তথ্য অনুসন্ধান, গ্রহণ ও প্রচারের স্বাধীনতাকে মৌলিক অধিকার হিসেবে স্বীকৃতি দেওয়া হয়েছে। আন্তর্জাতিক এসব অঙ্গীকারের অংশীজন হিসেবে বাংলাদেশ মতপ্রকাশের স্বাধীনতা রক্ষা, সাংবাদিকদের নিরাপত্তা নিশ্চিত করা এবং অযৌক্তিক বিধিনিষেধ পরিহারের বাধ্যবাধকতা বহন করে।

আইন ও সালিশ কেন্দ্র(আসক)মনে করে, দেশে গণমাধ্যমের স্বাধীনতা এখনও বহুমাত্রিক সংকট ও চ্যালেঞ্জের মুখোমুখি। সাংবাদিকদের বিরুদ্ধে মামলা, গ্রেপ্তারের আশঙ্কা, ডিজিটাল মাধ্যমে নাগরিকের মতপ্রকাশের কারণে হয়রানি, অনুসন্ধানী সাংবাদিকতার ক্ষেত্রে কৌশলগত চাপ, মালিকানাগত প্রভাব, আত্মনিয়ন্ত্রণমূলক সেন্সরশিপ এবং মাঠপর্যায়ে সংবাদ সংগ্রহে বাধা-এসব বাস্তবতা স্বাধীন সাংবাদিকতার পরিসরকে সংকুচিত করছে। অনেক ক্ষেত্রে সাংবাদিকদের ওপর হামলা, হুমকি ও নজরদারির অভিযোগও উঠে আসে, যা গভীর উদ্বেগের বিষয়।

একই সঙ্গে তথ্য অধিকার আইন কার্যকর প্রয়োগের সীমাবদ্ধতা, সরকারি তথ্যপ্রাপ্তিতে অনীহা এবং জনস্বার্থ সংশ্লিষ্ট তথ্য গোপন রাখার প্রবণতা গণতান্ত্রিক স্বচ্ছতাকে দুর্বল করে। গণমাধ্যম যদি তথ্যপ্রাপ্তিতে বাধাগ্রস্ত হয়, তবে জনগণও সত্য জানার অধিকার থেকে বঞ্চিত হয়।

বর্তমান সময়ে অসত্য তথ্য, অপতথ্য, হিংসা ছড়ানো ও ঘৃণাত্মক প্রচারণার চ্যালেঞ্জও আমাদের বাস্তবতা। তবে এ সকল চ্যালেঞ্জ মোকাবিলার উপায় স্বাধীন মতপ্রকাশ সীমিত করা নয়; বরং তথ্য যাচাইব্যবস্থা শক্তিশালী করা, গণমাধ্যমের পেশাগত মানোন্নয়ন, ডিজিটাল সাক্ষরতা বৃদ্ধি এবং জবাবদিহিমূলক নীতিমালা গড়ে তোলা।

বিশ্ব মুক্ত গণমাধ্যম দিবসে আইন ও সালিশ কেন্দ্র (আসক) নিম্নোক্ত প্রত্যাশা ব্যক্ত করছে-

১. সাংবাদিক ও গণমাধ্যমকর্মীদের নিরাপত্তা নিশ্চিত করতে কার্যকর সুরক্ষা ব্যবস্থা গ্রহণ করতে হবে।

২. মতপ্রকাশের স্বাধীনতার পরিপন্থী আইন, নীতি বা অপব্যবহার পর্যালোচনা ও সংস্কার করতে হবে।

৩. সাংবাদিকদের বিরুদ্ধে হামলা, সহিংসতা ও হয়রানির ঘটনার নিরপেক্ষ তদন্ত এবং দায়ীদের জবাবদিহি নিশ্চিত করতে হবে।

৪. তথ্য অধিকার আইন কার্যকরভাবে বাস্তবায়ন এবং সরকারি তথ্যপ্রাপ্তি সহজতর করতে হবে।

৫. রাষ্ট্র, গণমাধ্যম প্রতিষ্ঠান ও নাগরিক সমাজের যৌথ উদ্যোগে স্বাধীন, বহুমাত্রিক ও নৈতিক সাংবাদিকতার পরিবেশ গড়ে তুলতে হবে।

৬. নারী সাংবাদিক ও প্রান্তিক জনগোষ্ঠী থেকে আগত গণমাধ্যমকর্মীদের জন্য নিরাপদ ও বৈষম্যহীন কর্মপরিবেশ নিশ্চিত করতে হবে।

বিশ্ব মুক্ত গণমাধ্যম দিবস উপলক্ষে আইন ও সালিশ কেন্দ্র (আসক)-এর নির্বাহী পরিচালক তাহমিনা রহমান সংশ্লিষ্ট কর্তৃপক্ষকে আহ্বান জানিয়ে বলেছেন, “মুক্ত, স্বাধীন ও নিরাপদ গণমাধ্যম পরিবেশ নিশ্চিত করা একটি গণতান্ত্রিক রাষ্ট্রের মৌলিক দায়িত্ব। সাংবাদিকরা যাতে ভয়, চাপ ও হয়রানি ছাড়া পেশাগত দায়িত্ব পালন করতে পারেন, সে পরিবেশ প্রতিষ্ঠায় কার্যকর উদ্যোগ জরুরি। সংবাদমাধ্যমের স্বাধীনতা সুরক্ষিত হলে নাগরিকের অধিকারও অধিকতর সুরক্ষিত হয়।”
