Ain o Salish Kendra (ASK) expresses deep concern over the case of an 11-year-old child in Madan Upazila of Netrokona who has become pregnant. ASK believes that this incident is not merely a criminal offence; rather, it is a distressing reflection of the current state of child protection, social accountability and the safeguarding of children’s rights in Bangladesh.

According to reports published in the media, the accused madrasa teacher, Aman Ullah Sagar, was arrested today in connection with the incident. However, it has also been reported that certain individuals have been threatening the victim’s family on his behalf. At the same time, allegations of threats and harassment against the doctor who confirmed the child’s pregnancy have emerged in the media, which is particularly alarming. Such actions risk undermining the judicial process and compromising the environment necessary for ensuring justice.

ASK believes that the circumstances leading to an 11-year-old child becoming pregnant expose serious weaknesses in the child protection system. The child’s current physical condition, including malnutrition, her young age and the complications associated with pregnancy, places her life at significant risk. In this context, it is imperative to ensure immediate access to specialised medical treatment, close monitoring, psychosocial support and safe and dignified rehabilitation. This is not merely a matter of healthcare; it is a matter of safeguarding her life, development and future.

The National Children Policy 2011 places the best interests of the child at the centre of all decisions and commits to protecting children from all forms of abuse and exploitation. Likewise, the United Nations Convention on the Rights of the Child recognises the rights of children to life, protection, development and dignity as fundamental obligations of the State. The current incident raises an important question as to whether these commitments will remain only on paper or be meaningfully reflected in practice.

In this context, ASK strongly emphasises that ensuring the overall safety and security of the child and her family must be the highest priority. Effective measures must be taken to protect them from any form of social pressure, intimidation or retaliatory actions. At the same time, the safety and professional independence of the concerned doctor must be guaranteed so that medical duties can be carried out without fear or interference.

ASK calls upon the relevant authorities to ensure an impartial and fair investigation into the incident. Furthermore, ASK believes that ensuring a safe environment for children remains an unfulfilled commitment. Without strengthening accountability across educational institutions and all social settings, and without adopting effective preventive measures, it will not be possible to prevent the recurrence of such incidents.

নেত্রকোনার মদন উপজেলায় ১১ বছর বয়সী এক শিশুর অন্তঃসত্ত্বা হয়ে পড়ার ঘটনায় গভীর উদ্বেগ প্রকাশ করছে আইন ও সালিশ কেন্দ্র (আসক) । আসক মনে করে, ঘটনাটি আমাদের সামনে কেবল একটি অপরাধের বিবরণ নয়; এটি রাষ্ট্রীয় সুরক্ষা কাঠামো, সামাজিক দায়বদ্ধতা এবং শিশু অধিকার রক্ষার বাস্তব অবস্থার এক বেদনাদায়ক প্রতিফলন।

গণমাধ্যমে প্রকাশিত তথ্য অনুযায়ী, এ ঘটনায় অভিযুক্ত মাদ্রাসা শিক্ষক আমান উল্লাহ সাগর আজকে গ্রেফতার হয়েছে। যদিও  তাঁর পক্ষে কতিপয় ব্যক্তি হুমকি দিয়ে আসছে ভুক্তভোগীর পরিবারকে। একই সঙ্গে, শিশুটির অন্তঃসত্ত্বা হওয়ার বিষয়টি নিশ্চিত করা চিকিৎসকের প্রতি হুমকি ও হয়রানির অভিযোগও প্রকাশিত হয়েছে গনমাধ্যমে,যা বিশেষভাবে উদ্বেগজনক। এ ধরনের ঘটনা বিচার প্রক্রিয়াকে প্রভাবিত করার ঝুঁকি তৈরি করে এবং ন্যায়বিচারের পরিবেশকে ক্ষতিগ্রস্ত করে।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, ১১ বছর বয়সী একটি শিশুর এই অবস্থায় পৌঁছানো আমাদের শিশু সুরক্ষা ব্যবস্থার দুর্বলতাকে সামনে আনে। শিশুটির বর্তমান শারীরিক অবস্থা-পুষ্টিহীনতা, অল্প বয়স এবং গর্ভধারণের জটিলতা-তার জীবনের জন্য উচ্চ ঝুঁকি সৃষ্টি করছে। এই বাস্তবতায় তার জন্য অবিলম্বে বিশেষায়িত চিকিৎসা সেবা, নিবিড় পর্যবেক্ষণ, মানসিক সহায়তা এবং নিরাপদ ও মর্যাদাপূর্ণ পুনর্বাসন নিশ্চিত করা অপরিহার্য। এটি কেবল চিকিৎসার বিষয় নয়; এটি তার জীবন, বিকাশ ও ভবিষ্যৎ সুরক্ষার প্রশ্ন।

বাংলাদেশের জাতীয় শিশু নীতি, ২০১১ শিশুর সর্বোত্তম স্বার্থকে সকল সিদ্ধান্তের কেন্দ্রবিন্দুতে রাখার কথা বলে এবং সব ধরনের নির্যাতন ও শোষণ থেকে শিশুদের সুরক্ষা নিশ্চিত করার অঙ্গীকার ব্যক্ত করে। একইভাবে জাতিসংঘ শিশু অধিকার সনদে শিশুর জীবন, সুরক্ষা, বিকাশ এবং মর্যাদার অধিকার রাষ্ট্রের মৌলিক দায়িত্ব হিসেবে স্বীকৃত। বর্তমান ঘটনায় এসব নীতিমালা কেবল নথিভুক্ত অঙ্গীকার হয়ে থাকবে, নাকি বাস্তব প্রয়োগে প্রতিফলিত হবে-তা এখন একটি গুরুত্বপূর্ণ প্রশ্ন।

এই প্রেক্ষাপটে আইন ও সালিশ কেন্দ্র (আসক) জোর দিয়ে বলছে, শিশুটি ও তার পরিবারের সার্বিক নিরাপত্তা নিশ্চিত করা এখন সর্বোচ্চ অগ্রাধিকার হওয়া উচিত। কোনো ধরনের সামাজিক চাপ, ভয়ভীতি বা প্রতিশোধমূলক আচরণ থেকে তাদের সুরক্ষায় কার্যকর ব্যবস্থা নিতে হবে। একই সঙ্গে, সংশ্লিষ্ট চিকিৎসকের নিরাপত্তা ও পেশাগত স্বাধীনতা নিশ্চিত করা প্রয়োজন, যাতে নির্ভয়ে দায়িত্ব পালন করতে পারেন।

আইন ও সালিশ কেন্দ্র (আসক) সংশ্লিষ্ট কর্তৃপক্ষের নিকট দাবি জানাচ্ছে, এ ঘটনায় নিরপেক্ষ ও সুষ্ঠু তদন্ত নিশ্চিত করা হোক। পাশাপাশি, আসক মনে করে শিশুদের জন্য নিরাপদ পরিবেশ নিশ্চিত করা এখনো একটি অপূর্ণ অঙ্গীকার। শিক্ষা প্রতিষ্ঠানসহ সকল সামাজিক পরিসরে জবাবদিহিতা জোরদার এবং কার্যকর প্রতিরোধমূলক ব্যবস্থা গ্রহণ ছাড়া এ ধরনের ঘটনার পুনরাবৃত্তি রোধ করা সম্ভব নয়।
