Push-Ins at the Border and Keeping People Stranded in No-Man’s-Land Are Contrary to Human Dignity and International Human Rights Principles: Ain o Salish Kendra (ASK)

Ain o Salish Kendra (ASK) expresses its deep concern over the recent incidents along various points of the Bangladesh–India border, where many people, including women, children and elderly persons, have reportedly been subjected to attempts to forcibly push them into Bangladesh (pushbacks) and have been compelled to remain in the no-man’s land for prolonged periods.

According to media reports, such situations have arisen at several points along the Bangladesh border where the Indian authorities have allegedly attempted to compel individuals to enter the territory of Bangladesh without first completing a proper, transparent and lawful process to verify their nationality and identity. In many cases, women, children and other vulnerable persons have also been affected.

ASK believes that even where a person is suspected of being a national of another country, they must not be subjected to inhuman, cruel or degrading treatment under any circumstances. A person’s dignity, security and fundamental rights do not depend on their nationality, religion, language or migration status. One of the fundamental principles of international human rights law is that every individual is entitled to protection by virtue of their inherent human dignity.

ASK wishes to emphasise that, in light of the Universal Declaration of Human Rights, no one should be placed in a situation where their life, security, health or human dignity is put at risk. States have established diplomatic and administrative mechanisms for determining the identity and legal status of persons detained or present at border areas. Bypassing these recognised procedures and forcibly pushing people towards another country’s territory amounts to prioritising the use of force over the rule of law.

Of particular concern are recent reports indicating that many people have been forced to remain in the no-man’s land for days. Depriving individuals in such uncertain border conditions of basic necessities, including food, safe drinking water, medical care and secure shelter, is not only contrary to humanitarian values but may also amount to cruel, inhuman or degrading treatment.

ASK further believes that any question regarding whether a person is a citizen of Bangladesh or of another country must be resolved through transparent, lawful and mutually recognised procedures. Such matters should be addressed through cooperation between States, including information sharing, identity verification and appropriate diplomatic engagement.

In this context, ASK calls upon the relevant authorities of both Bangladesh and India to address the situation with full respect for human rights, the rule of law and humanitarian principles. It urges both governments to ensure the safety, dignity and humanitarian protection of every individual present at the border and to refrain from any form of pushback or any attempt to compel people to cross the border by force.

সীমান্তে পুশইন ও শূন্যরেখায় মানুষকে আটকে রাখার ঘটনা মানবিক মর্যাদা ও আন্তর্জাতিক মানবাধিকার নীতির পরিপন্থীঃ আইন ও সালিশ কেন্দ্র (আসক)

বাংলাদেশ-ভারত সীমান্তের বিভিন্ন এলাকায় সাম্প্রতিক সময়ে নারী, শিশু ও প্রবীণ ব্যক্তিসহ বহু মানুষকে জোরপূর্বক বাংলাদেশের দিকে ঠেলে দেওয়ার (পুশইন) চেষ্টা এবং তাদের দীর্ঘ সময় শূন্যরেখায় অবস্থান করতে বাধ্য করার ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) গভীর উদ্বেগ প্রকাশ করছে।

গণমাধ্যমে প্রকাশিত প্রতিবেদন অনুসারে, বাংলদেশ সীমান্তের বিভিন্ন পয়েন্টে এমন পরিস্থিতির সৃষ্টি হয়েছে যেখানে সংশ্লিষ্ট ব্যক্তিদের জাতীয়তা ও পরিচয় সম্পর্কে যথাযথ, স্বচ্ছ এবং আইনসম্মত যাচাই প্রক্রিয়া সম্পন্ন না করেই তাদের বাংলাদেশের ভূখণ্ডে প্রবেশে বাধ্য করার চেষ্টা করছে ভারতীয় কর্তৃপক্ষ। অনেক ক্ষেত্রে নারী, শিশু এবং অন্যান্য ঝুঁকিপূর্ণ ব্যক্তিরাও এই পরিস্থিতির শিকার হয়েছেন।

আইন ও সালিশ কেন্দ্র (আসক) মনে করে, কোনো ব্যক্তি অন্য দেশের নাগরিক বলে সন্দেহ করা হলেও তার প্রতি অমানবিক, নিষ্ঠুর বা অবমাননাকর আচরণ কোনোভাবেই গ্রহণযোগ্য হতে পারে না। মানুষের মর্যাদা, নিরাপত্তা এবং মৌলিক অধিকার তার জাতীয়তা, ধর্ম, ভাষা বা অভিবাসন সংক্রান্ত অবস্থানের ওপর নির্ভরশীল নয়। আন্তর্জাতিক মানবাধিকার আইনের অন্যতম মৌলিক নীতি হলো – প্রত্যেক মানুষ তার মানবিক মর্যাদার কারণে সুরক্ষা পাওয়ার অধিকারী।

আসক বিশেষভাবে উল্লেখ করতে চায় যে, আন্তর্জাতিক মানবাধিকার ঘোষণাপত্রের আলোকে কাউকে এমন পরিস্থিতিতে ঠেলে দেওয়া যায় না, যেখানে তার জীবন, নিরাপত্তা, স্বাস্থ্য কিংবা মানবিক মর্যাদা ঝুঁকির মুখে পড়ে। সীমান্তে আটক বা অবস্থানরত ব্যক্তিদের পরিচয় ও আইনি অবস্থান নির্ধারণের জন্য রাষ্ট্রগুলোর হাতে বিভিন্ন কূটনৈতিক ও প্রশাসনিক ব্যবস্থা বিদ্যমান রয়েছে। সেই প্রক্রিয়া অনুসরণ না করে মানুষকে জোরপূর্বক অন্য দেশের দিকে ঠেলে দেওয়া আইনের শাসনের পরিবর্তে শক্তির প্রয়োগকে প্রাধান্য দেওয়ার শামিল।

এখানে উদ্বেগের বিষয় হলো, সাম্প্রতিক ঘটনাগুলোতে বহু মানুষকে শূন্যরেখায় দিনের পর দিন অবস্থান করতে বাধ্য করা হয়েছে বলে সংবাদমাধ্যমে উঠে এসেছে। সীমান্তের এমন অনিশ্চিত পরিবেশে খাদ্য, বিশুদ্ধ পানি, চিকিৎসা এবং নিরাপদ আশ্রয়ের মতো মৌলিক প্রয়োজন থেকে মানুষকে বঞ্চিত করা কেবল মানবিক মূল্যবোধের পরিপন্থী নয়; এটি অনেক ক্ষেত্রে নিষ্ঠুর, অমানবিক ও অবমাননাকর আচরণের পর্যায়েও বিবেচিত হতে পারে।

আইন ও সালিশ কেন্দ্র (আসক) আরো মনে করে, কোনো ব্যক্তি বাংলাদেশের নাগরিক কি না কিংবা অন্য কোনো দেশের নাগরিক কি না- এই প্রশ্নের সমাধান অবশ্যই স্বচ্ছ, আইনসম্মত এবং পারস্পরিকভাবে স্বীকৃত প্রক্রিয়ার মাধ্যমে হওয়া উচিত। রাষ্ট্রগুলোর মধ্যে তথ্য বিনিময়, পরিচয় যাচাই এবং প্রয়োজনীয় কূটনৈতিক উদ্যোগের মাধ্যমেই এ ধরনের বিষয় নিষ্পত্তি হওয়া বাঞ্ছনীয়।

এই প্রেক্ষাপটে আইন ও সালিশ কেন্দ্র (আসক) বাংলাদেশ ও ভারতের সংশ্লিষ্ট কর্তৃপক্ষের প্রতি আহ্বান জানাচ্ছে, তারা যেন মানবাধিকার, আইনের শাসন এবং মানবিক মূল্যবোধের প্রতি শ্রদ্ধাশীল থেকে পরিস্থিতি মোকাবিলা করে। সীমান্তে অবস্থানরত প্রত্যেক মানুষের নিরাপত্তা, মর্যাদা এবং মানবিক সুরক্ষা নিশ্চিত করা এবং যেকোনো ধরনের পুশইন বা জোরপূর্বক সীমান্ত অতিক্রমে বাধ্য করার প্রচেষ্টা থেকে বিরত থাকা বর্তমান পরিস্থিতিতে অত্যন্ত জরুরি।
