Ain o Salish Kendra (ASK) strongly protests and expresses deep concern over the incident in Trishal, Mymensingh, in which an employee of a sand leaseholder was allegedly slapped and beaten with a stick by the Upazila Nirbahi Officer (UNO).
According to media reports and video footage, on 12 August 2026, during a mobile court operation in the Kalir Bazar area, Trishal UNO Arafat Siddiqui allegedly slapped a manager of the sand leaseholder twice and struck him with a stick. The reports further stated that the injured person was subsequently admitted to hospital.
ASK believes that the physical assault of a citizen by a government official responsible for enforcing the law is deeply concerning. Even if a person is suspected of violating the law, they must be held accountable through due legal process. No one has the authority to take the law into their own hands in the name of law enforcement.
No provision of the Mobile Court Act, 2009 grants an Executive Magistrate the authority to slap, beat with a stick or physically punish any individual. The Mobile Court Act provides the authority to conduct summary trials for specified offences and impose penalties prescribed by law. Physically assaulting or humiliating an individual is not part of such authority.
When a government official is entrusted with enforcing the law of the state, their conduct is expected to reflect the highest degree of respect for the law and restraint. The authority vested in them is not a power to humiliate or physically punish citizens. Respecting the dignity of individuals while exercising state power is not a matter of discretion; it is a constitutional obligation.
In this context, ASK raises the following questions: On what legal authority did the concerned UNO slap a citizen and strike him with a stick? Which provision of the Mobile Court Act authorised him to inflict such physical punishment? If no such legal authority exists, there is no basis for treating such conduct as part of the operation of a mobile court.
Ain o Salish Kendra (ASK) believes that an impartial and effective investigation into the incident is essential. The concerned authorities should initiate an investigation suo motu, without waiting solely for a written complaint from the victim. All relevant evidence, including video footage, statements from eyewitnesses and the victim’s medical records, must be preserved and examined as part of the investigation. The findings of the investigation should also be made public and if responsibility is established, appropriate action must be taken against the concerned official in accordance with law and applicable regulations.

মোবাইল কোর্ট পরিচালনার নামে নাগরিককে চড়-থাপ্পড় ও লাঠিপেটার ক্ষমতা কোনো নির্বাহী ম্যাজিস্ট্রেটের নেই: আইন ও সালিশ কেন্দ্র (আসক)
ময়মনসিংহের ত্রিশালে বালুর ঘাটে ইজারাদারের এক কর্মীকে উপজেলা নির্বাহী কর্মকর্তা (ইউএনও) কর্তৃক চড়-থাপ্পড় ও লাঠি দিয়ে মারধরের ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) তীব্র প্রতিবাদ ও গভীর উদ্বেগ প্রকাশ করছে।
গণমাধ্যমে প্রকাশিত সংবাদ ও ভিডিও ফুটেজে দেখা যায়, গত ১২ আগস্ট ২০২৬ কালীরবাজার এলাকায় মোবাইল কোর্ট অভিযানের সময় ত্রিশালের ইউএনও আরাফাত সিদ্দিকী ইজারাদারের এক ব্যবস্থাপককে পরপর দুটি থাপ্পড় মারেন এবং লাঠি দিয়ে তাঁকে আঘাত করেন। পরে আহত ব্যক্তিকে হাসপাতালে ভর্তি করা হয় বলে সংবাদে উল্লেখ করা হয়েছে।
আসক মনে করে, আইন প্রয়োগের দায়িত্বে থাকা একজন সরকারি কর্মকর্তার হাতে একজন নাগরিকের এভাবে শারীরিকভাবে লাঞ্ছিত হওয়া অত্যন্ত উদ্বেগজনক। কোনো ব্যক্তি আইন লঙ্ঘন করেছেন বলে সন্দেহ হলেও তাঁকে আইনানুগ প্রক্রিয়ার মধ্যেই জবাবদিহির আওতায় আনতে হবে। আইন প্রয়োগের নামে আইন নিজের হাতে তুলে নেওয়ার সুযোগ কারও নেই।
মোবাইল কোর্ট আইন, ২০০৯-এর কোনো বিধানেই কোনো ব্যক্তিকে চড়-থাপ্পড়, লাঠিপেটা বা শারীরিকভাবে শাস্তি দেওয়ার ক্ষমতা নির্বাহী ম্যাজিস্ট্রেটকে দেওয়া হয়নি। মোবাইল কোর্ট আইনে নির্দিষ্ট অপরাধের ক্ষেত্রে তাৎক্ষণিক বিচার এবং আইনে নির্ধারিত শাস্তি প্রদানের ক্ষমতা দেওয়া হয়েছে। কাউকে শারীরিকভাবে আঘাত করা বা লাঞ্ছিত করা সেই ক্ষমতার অংশ নয়।
একজন সরকারি কর্মকর্তা যখন রাষ্ট্রের আইন প্রয়োগের দায়িত্বে থাকেন, তখন তাঁর আচরণে আইনের প্রতি সর্বোচ্চ শ্রদ্ধা ও সংযম প্রতিফলিত হওয়ার কথা। তাঁর হাতে অর্পিত ক্ষমতা নাগরিককে অপমান বা শারীরিকভাবে শাস্তি দেওয়ার ক্ষমতা নয়। রাষ্ট্রীয় ক্ষমতা প্রয়োগের ক্ষেত্রে ব্যক্তির মর্যাদা রক্ষা কোনো অনুগ্রহ নয়; এটি সাংবিধানিক বাধ্যবাধকতা।
এ অবস্থায় আসক এর প্রশ্ন-কোন আইনি এখতিয়ারের ভিত্তিতে সংশ্লিষ্ট ইউএনও একজন নাগরিককে চড় মারলেন এবং লাঠি দিয়ে আঘাত করলেন? মোবাইল কোর্টের কোন বিধান তাঁকে এ ধরনের শারীরিক শাস্তি দেওয়ার ক্ষমতা দিয়েছে? এমন কোনো আইনগত ক্ষমতা না থাকলে এ ধরনের আচরণকে মোবাইল কোর্ট পরিচালনার অংশ হিসেবে দেখার সুযোগ নেই।
আইন ও সালিশ কেন্দ্র (আসক) মনে করে, ঘটনাটির নিরপেক্ষ ও কার্যকর তদন্ত হওয়া জরুরি। শুধু ভুক্তভোগীর লিখিত অভিযোগের অপেক্ষায় না থেকে সংশ্লিষ্ট কর্তৃপক্ষের উচিত স্বতঃপ্রণোদিতভাবে ঘটনার তদন্ত করা। ভিডিও ফুটেজ, প্রত্যক্ষদর্শীদের বক্তব্য এবং ভুক্তভোগীর চিকিৎসা-সংক্রান্ত তথ্যসহ সংশ্লিষ্ট সব প্রমাণ সংরক্ষণ করে তদন্ত করতে হবে। একই সঙ্গে তদন্তের ফলাফল জনসমক্ষে প্রকাশ করতে হবে এবং দায় প্রমাণিত হলে সংশ্লিষ্ট কর্মকর্তার বিরুদ্ধে আইন ও বিধি অনুযায়ী ব্যবস্থা গ্রহণ করতে হবে।
