Ain o Salish Kendra (ASK) strongly condemns and protests the arrest of 60-year-old Mohammad Kalim Uddin, whose son could not be found during a police raid at their home in Dhamrai, Dhaka, conducted to arrest a Jubo League activist.
According to media reports, police raided the home of Jubo League activist Rifat Ahmed to arrest him. Unable to find him, the police took his father, Kalim Uddin, to the police station and subsequently showed him as arrested in a ‘pending case’. According to the police, Kalim Uddin had no previous cases against him and was not an office-bearer of the Awami League. The police also stated that he was arrested on the basis of information that he was a supporter of the Awami League.
Ain o Salish Kendra (ASK) believes that arresting a family member because another person cannot be found in the name of law enforcement is unacceptable in any civilised, democratic and human rights-based state. Holding one person responsible for another person’s actions violates the fundamental principles of individual accountability, justice and the rule of law.
Article 31 of the Constitution of Bangladesh guarantees every citizen the right to seek the protection of the law and to be treated in accordance with the law. Article 32 guarantees protection against deprivation of life or personal liberty except in accordance with law. Article 9 of the International Covenant on Civil and Political Rights (ICCPR) also safeguards individuals against arbitrary arrest and detention.
It is worth noting that under previous governments, allegations have repeatedly arisen of false cases, harassment, detention and arrests of citizens based on their political affiliations, family relationships or the actions of other individuals. ASK believes that a change of government must also bring a change in the culture of state conduct. The current government must completely abandon the culture of detention, harassment and arrests that has instilled fear among citizens in the past.
In this context, Ain o Salish Kendra (ASK) demands the immediate and unconditional release of Mohammad Kalim Uddin if there are no specific and lawful allegations against him. At the same time, law enforcement agencies must be given clear instructions to ensure that no family member is detained, arrested or harassed because of the political affiliation or activities of another member of the family.
