Six Years Old Lose Leg Due to Negligence of Launch Driver

On 29 December 2017, Md Jamaluddin along with his 6-year-old daughter Jaima Newaz Jisha came to Fatulla launch terminal to go to Amtoli of Barguna. When they were about to get into the MV Yead Lauch, an Amtoli bound launch, suddenly the launch hit the terminal by moving from left to the right and Jaima’s leg got stuck. Though they screamingly asked to stop the movement of the launch, none of the launch personnel including the supervisor, master, and security staff paid heed to their call. They kept the launch running. Consequently, the fingers of her right foot were cut off, following which her right leg had to be amputated.

Jamaluddin filed a suit against six people including the owner of the launch. But police made charge sheet without naming either the manager or the owner of the launch. Being unsatisfied with this charge sheet, Jamaluddin sought ASK’s assistance. On behalf of Jamaluddin, ASK submitted a Naraji Petition to the Court. After hearing the petition, the court ordered for a re-investigation by the PBI. Later, on ASK along with Jamaluddin filed a writ petition before the High Court on 14 November 2019, seeking compensation of 50,00,000 Taka for the losses suffered by Jamia. The High Court issued a rule, ordering the owners of MV Yead Launch to immediately pay Tk3 lakh within 30 days, for the medical treatment of Zaima Newaz. However, the owners had not paid it all this while.

On 11 February 2020, MV Yead Launch owner, Mamun-ur Rashid, handed over the required 3 lacs Taka (in pay-order) to Jamia’s father in the presence of the lawyers of both the parties for the treatment of Jamia.
