Ain o Salish Kendra (ASK) expresses concern over the filing of charges of crimes against humanity against journalists Farzana Rupa and Mozammel Haque Babu before the International Crimes Tribunal in connection with the 2013 Shapla Chattar incident, and the progression of judicial proceedings against them. ASK believes that it is essential to establish the truth regarding the reported loss of life and human rights violations during the Shapla Chattar incident and to hold those responsible accountable. At the same time, justice, freedom of expression and the right to independent journalism must also be ensured throughout this process.

ASK believes that, in cases involving allegations of serious crimes, the role and liability of the individuals concerned must be determined on the basis of due evidence. At the same time, careful consideration must be given to whether the publication of news about an incident or an editorial decision has any connection to the alleged crime. Performing professional journalistic duties is not the same as participating in or facilitating a crime. Therefore, these two matters should be considered separately.

Amnesty International, ARTICLE 19, CIVICUS, the Committee to Protect Journalists (CPJ) and Human Rights Watch have also expressed concern over the allegations against Farzana Rupa and Mozammel Haque Babu. In a joint statement issued on 15 July 2026, the organisations raised concerns regarding freedom of expression in relation to treating professional journalistic and editorial decisions as crimes against humanity.

ASK further believes that in an important judicial process such as that before the International Crimes Tribunal, it is essential to uphold the rule of law, impartiality, transparency and international standards of justice. The seriousness of the allegations must in no way undermine the accused persons’ right to defend themselves and their right to a fair trial. Identifying an accused person as guilty before a final judicial determination in a matter under trial is also contrary to the fundamental principles of justice.

Ain o Salish Kendra (ASK) calls upon the concerned authorities to ensure that the ongoing judicial proceedings against Farzana Rupa and Mozammel Haque Babu are conducted in a transparent, impartial and fair manner, and that their legal rights and right to justice are fully guaranteed.

সাংবাদিক ফারজানা রূপা ও মোজাম্মেল হক বাবুর বিরুদ্ধে মানবতাবিরোধী অপরাধের অভিযোগ নিয়ে আইন ও সালিশ কেন্দ্র (আসক)-এর উদ্বেগ

সাংবাদিক ফারজানা রূপা ও মোজাম্মেল হক বাবুর বিরুদ্ধে ২০১৩ সালের শাপলা চত্বরের ঘটনাকে কেন্দ্র করে আন্তর্জাতিক অপরাধ ট্রাইব্যুনালে মানবতাবিরোধী অপরাধের অভিযোগ আনা এবং তাঁদের বিরুদ্ধে বিচারিক কার্যক্রম এগিয়ে যাওয়ার ঘটনায় আইন ও সালিশ কেন্দ্র (আসক) উদ্বেগ প্রকাশ করছে। আসক মনে করে, শাপলা চত্বরের ঘটনায় প্রাণহানি ও মানবাধিকার লঙ্ঘনের অভিযোগের সত্য উদ্‌ঘাটন এবং দায়ীদের জবাবদিহির আওতায় আনা জরুরি। একই সঙ্গে এ প্রক্রিয়ায় ন্যায়বিচার, মতপ্রকাশের স্বাধীনতা ও স্বাধীন সাংবাদিকতার অধিকারও নিশ্চিত করতে হবে।

আসক মনে করে, কোনো গুরুতর অপরাধের অভিযোগের ক্ষেত্রে সংশ্লিষ্ট ব্যক্তির ভূমিকা ও দায় যথাযথ প্রমাণের ভিত্তিতে নির্ধারণ করা প্রয়োজন। একই সঙ্গে কোনো ঘটনার সংবাদ প্রকাশ বা সম্পাদকীয় সিদ্ধান্তের সঙ্গে সেই অপরাধের কোনো সম্পর্ক রয়েছে কি না, সেটিও সতর্কতার সঙ্গে বিবেচনা করা প্রয়োজন। সাংবাদিকতার পেশাগত দায়িত্ব পালন এবং কোনো অপরাধে অংশগ্রহণ বা সহায়তার বিষয় এক নয়। তাই এ দুটি বিষয়কে আলাদাভাবে বিবেচনা করা সমীচীন।

সাংবাদিক ফারজানা রূপা ও মোজাম্মেল হক বাবুর বিরুদ্ধে আনা অভিযোগ নিয়ে অ্যামনেস্টি ইন্টারন্যাশনাল, আর্টিকেল ১৯, সিভিকাস, কমিটি টু প্রটেক্ট জার্নালিস্টস (সিপিজে) এবং হিউম্যান রাইটস ওয়াচও উদ্বেগ প্রকাশ করেছে। ১৫ জুলাই ২০২৬-এর যৌথ বিবৃতিতে সংগঠনগুলো সাংবাদিকতার পেশাগত ও সম্পাদকীয় সিদ্ধান্তকে মানবতাবিরোধী অপরাধ হিসেবে বিবেচনা করার বিষয়ে মতপ্রকাশের স্বাধীনতার উদ্বেগের কথা জানিয়েছে।

আসক আরো  মনে করে, আন্তর্জাতিক অপরাধ ট্রাইব্যুনালের মতো গুরুত্বপূর্ণ বিচারিক প্রক্রিয়ায় আইনের শাসন, নিরপেক্ষতা, স্বচ্ছতা ও ন্যায়বিচারের আন্তর্জাতিক মানদণ্ড অনুসরণ করা জরুরি। অভিযোগের গুরুত্ব কোনোভাবেই অভিযুক্ত ব্যক্তির আত্মপক্ষ সমর্থনের অধিকার ও ন্যায়বিচার পাওয়ার অধিকারকে খর্ব করতে পারে না। বিচারাধীন কোনো বিষয়ে আদালতের চূড়ান্ত সিদ্ধান্তের আগে অভিযুক্ত ব্যক্তিকে অপরাধী হিসেবে চিহ্নিত করাও ন্যায়বিচারের মৌলিক নীতির পরিপন্থী।

আইন ও সালিশ কেন্দ্র (আসক) সংশ্লিষ্ট কর্তৃপক্ষের প্রতি আহ্বান জানাচ্ছে, ফারজানা রূপা ও মোজাম্মেল হক বাবুর বিরুদ্ধে চলমান বিচারিক প্রক্রিয়া যেন স্বচ্ছ, নিরপেক্ষ ও ন্যায়সংগতভাবে পরিচালিত হয় এবং তাঁদের আইনি অধিকার ও ন্যায়বিচার নিশ্চিত করা হয়।
