Denial of appointment of a physically challenged person despite succeeding in the selection process as Assistant Manager (Mechanical) in Bangladesh Gas Fields Company Limited by violating the provisions of Bangladesh Protibandhi Kallayan Ain, 2001 (Bangladesh Disabled Welfare Act 2001). Provided that the aggrieved petitioner Nurur Rahman became handicapped due to medical negligence and finally completed his graduation from BUET.

Court’s Response:

The Court issued a Rule Nisi on 09.04.2008 upon the respondents to show cause as to why the inaction in not providing job to petitioner no-2 with disabilities violating provisions set forth in the Protibandhi Kallayan Ain, 2001 and not including petitioner Md. Nurur Rahman for the post of Assistant Manager (Mechanical) in Bangladesh Gas Fields Company Limited should not be declared to have been done illegally, without lawful authority and to be of no legal effect and as to why the Managing Director, Bangladesh Gas Fields Company Limited shall not be directed to appoint Md. Nurur Rahman as Assistant Manager .
